RELATING TO LIQUOR. Provides that violations of liquor tax law shall be referred to the director of taxation for investigation. Repeals the general right of inspection without a warrant for potential violations of liquor tax law. Repeals the discretionary power of the liquor commission to deny a license to any person the commission finds is not fit and proper to hold a license. Requires applications for liquor licenses to be notarized. Provides the administrator of the liquor commission discretion over whether to refer applications for investigation. Repeals the requirement that investigative reports to the liquor commission include any and all matters that are relevant to the application or license in the judgment of the investigator.

RELATING TO UTILITIES. Requires the public utilities commission to explore, through its docket process, solutions to the problems posed by siting of above-ground electrical infrastructure in high-risk areas. Requires the public utilities commission to submit a report to the legislature prior to the regular session of 2022. Effective 7/1/2050. (HD1)

RELATING TO SUNSCREENS. Beginning January 1, 2023, bans the sale, offer of sale, or distribution in the State of any sunscreen that contains avobenzone or octocrylene, or both, without a prescription issued by a licensed healthcare provider to preserve marine ecosystems. Effective 7/1/2050. (HD1)

RELATING TO EMERGENCY MEDICAL SERVICES. Allows emergency medical personnel who successfully complete National Registry of Emergency Medical Technicians certification to be qualified to perform emergency medical services as emergency medical technicians. Effective 7/1/2060. (HD1)

RELATING TO HEALTH. Clarifies the group of professionals who are prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals the landlord exclusion. Requires the department of health to prioritize complaint allegations based on severity for inspections of state-licensed or state-certified care facilities. RELATING TO TAXATION. Increases the amount of the rental motor vehicle surcharge tax from $5 to an unspecified amount. Effective 7/1/2050. (HD1)

Requires the department of human services to compile information regarding employers having employees who receive public assistance and to submit an annual report to the legislature on the 50 employers with the highest number of employees receiving public assistance. RELATING TO ADVANCED PRACTICE REGISTERED NURSES. Authorizes advanced practice registered nurses to certify whether a person is totally disabled under the income tax code. Authorizes advanced practice registered nurses with psychiatric specializations to make capacity determinations. Adds advanced practice registered nurses with psychiatric specializations as primary providers in advance mental health care directives. Effective 7/1/2060. (HD1)

RELATING TO HEALTH CARE. Authorizes licensed physician assistants and advanced practice registered nurses to perform aspiration abortions. Effective 7/1/2060. (HD1)

RELATING TO TOBACCO PRODUCTS. Establishes the offense of unlawful shipment of tobacco products. Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes and tobacco products. Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products. Allocates a portion of funds collected from excise taxes on tobacco products to health education and prevention programs concerning the risks and dangers of the use of electronic smoking devices for youth. Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices. Effective 7/1/2050. (HD1)

RELATING TO TAXATION. Imposes a fifty per cent tax on products with a modified risk tobacco product order issued by the Secretary of the United States Department of Health and Human Services. Establishes taxation of e-liquids used in electronic smoking devices. Requires wholesalers and dealers to be licensed. Requires retailers of tobacco and e-liquids to obtain permits. Effective 7/1/2060. (HD1)

RELATING TO ELECTRONIC SMOKING DEVICES. Expands the purposes for which moneys in the tobacco enforcement special fund may be used to include all functions of the department of the attorney general. Renames the electronic smoking device retailer registration unit the electronic smoking device retailer registration and enforcement unit. Expands the scope of the unit to include enforcement of compliance of electronic smoking devices with the Federal Food, Drug, and Cosmetic Act. Establishes a special fund for moneys received from enforcement actions. Amends the fine amount for persons under twenty-one years of age who purchase or possess tobacco products or electronic smoking devices. Effective 07/01/2060. (HD1)

RELATING TO HEMP. Clarifies the regulation of growing hemp, hemp processing, and hemp product manufacturing in the State. Repeals the sunset date of Act 14, Session Laws of Hawaii 2020. (HD1)

RELATING TO AGRICULTURE. Exempts from general excise tax law amounts received from the interisland transportation and related loading and unloading of livestock. Requires the public utilities commission to authorize preferential water carrier service rates by tariff for ratepayers that operate farms or ranches located in any county with a population equal to or less than 500,000. Effective 1/1/2050. (HD1)

RELATING TO AUTHORIZING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO LEASE PASTURE LANDS ON TERMS THAT PROMOTE COLLABORATIVE BENEFICIAL USE FOR FORESTRY, WILDLIFE, RECREATIONAL, AND FOOD PRODUCTION PURPOSES. Authorizes the board of land and natural resources to amend and extend existing pasture leases and to issue new pasture leases by negotiation in furtherance of public purposes the department of land and natural resources is responsible for promoting. Gives priority to the department of land and natural resources to use land that was transferred for productive agricultural uses, subject to certain conditions. Requires a third-party advisory committee to be established before the disposition or transfer of any disputed lands. Effective 1/1/2050. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
