RELATING TO CONDOMINIUMS. Excludes a homeowner-developer from the annual requirement to file a developer's report and pay a fee if the homeowner's development consists of not more than two units, one in which the developer resides and one for which the initial sale of the other unit has been completed.

RELATING TO CONDOMINIUMS. Makes violations of voting requirements for elections of a condominium association subject to the enforcement powers of the Real Estate Commission and amends the requirements for a condominium association's standard proxy form by deleting the option for a condominium owner to give the proxy to the board as a whole.

RELATING TO CONDOMINIUMS. Provides a process for associations to incorporate power of sale language into governing documents. Clarifies that the explicit grant of power of sale to associations is not required for the purposes of enforcing association liens under the association alternate power of sale foreclosure process.

RELATING TO THE PROTECTION OF TENANTS. Prohibits landlords from recovering possession of a dwelling unit from tenants if habitability of the premises is significantly impaired. Sets a tenant's liability for rent if habitability of the premises is significantly impaired. Specifies that the damages for retaliatory evictions are equal to two months' rent or free occupancy for two months.

RELATING TO THE LANDLORD-TENANT CODE. Proposed HD1: Extends the period for a notice of summary possession from five days to fifteen. Requires landlords to enter into mediation and delays when a landlord may seek possession of a dwelling unit if the tenant schedules or attempts to schedule mediation. Requires landlords to provide the notice to mediation centers that offer free mediation for residential landlord-tenant disputes. Restricts when a landlord may exercise these remedies depending on the amount of rent due. Appropriates funds for the office of the administrative director to administer required mediation. Repeals one year after the expiration date of the final eviction moratorium imposed pursuant to a COVID-19 state of emergency proclamation.

RELATING TO THE STATE BUILDING CODE COUNCIL. Requires the state building code council to: consider the impact of building codes and standards on the cost of single- and multi-family homes built in the State when considering whether to adopt a code or standard; and include with its annual written report to the governor a financial impact assessment on each code and standard adopted by the council.

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW. Authorizes the Director of Labor and Industrial Relations to prohibit the operation of pressure retaining items, amusement rides, and elevators and kindred equipment if inspection fees or fines are not paid timely; deletes the boiler and elevator fee schedule; effective upon approval.

RELATING TO CONTESTED CASES. Requires any state agency that does not have hearings officers on its staff to arrange with the department of commerce and consumer affairs to have its contested case hearings heard by hearings officers of the department. Allows the department of commerce and consumer affairs to charge a fee for conducting these hearings.

RELATING TO ENERGY EFFICIENCY. Requires that the state building code council include voting members with experience and knowledge in building energy efficiency standards and sustainable building, design, construction, and operation. Requires that the counties amend or adopt their respective building codes and standards based upon the International Energy Conservation Code no later than one year after the adoption of the Hawaii state building energy conservation code. Effective 7/1/2050. (HD1)

RELATING TO ELECTRIC FOOT SCOOTERS. Establishes a framework for the regulation of electric foot scooters by the State and counties. Amends definitions of "moped" to exclude electric foot scooters. Retains personal injury protection benefits for any individual sustaining injuries while using or operating an electric foot scooter.

RELATING TO THE UNDERGROUND CONSTRUCTION OF HIGH-VOLTAGE ELECTRIC TRANSMISSION LINES. Eliminates the requirement for a public utility to seek approval from the public utilities commission for the underground construction of high-voltage electric transmission lines if certain conditions are met. Effective 7/1/2050. (HD1)

RELATING TO RENEWABLE ENERGY. Prohibits after December 31, 2045, the use of fossil fuels for electricity generation or grid-tied battery energy storage. Effective 7/1/2050. (HD1)

RELATING TO ENERGY EFFICIENCY. Authorizes the Chief Energy Officer of the Hawaii State Energy Office to adopt rules to enforce minimum efficiency standards for certain products and establish or amend appliance efficiency standards in certain situations. Regulates the appliance efficiency standards for air purifiers and portable electric spas. Effective 7/1/2050. (HD1)

RELATING TO LIQUOR. Establishes a three-year surcharge on the liquor tax. Repeals 06/30/2024.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
