RELATING TO THE ADVISORY COMMITTEE ON PESTICIDES. Removes the statutory requirement for representatives of the pineapple and sugar industries and adds the statutory requirement for representatives of the coffee and diversified agriculture industries on the Advisory Committee on Pesticides.

RELATING TO AGRICULTURAL LANDS. Amends certain land subdivision and condominium property regime laws related to agricultural land, as recommended pursuant to Act 278, Session Laws of Hawaii 2019, to ensure condominium property regime projects within the agricultural district are used for agricultural purposes.

RELATING TO COMMON INTEREST AGRICULTURAL COMMUNITIES. Establishes a regulatory structure for common interest agricultural communities on lands classified as agricultural. Specifies requirements for development, creation, registration, governance, and management of common interest agricultural communities. Requires county approval of proposed common interest agricultural community projects. Prohibits approval for condominium property regimes created under chapter 514B, Hawaii Revised Statutes, on lands classified as agricultural.

RELATING TO THE IMPORTANT AGRICULTURAL LAND QUALIFIED AGRICULTURAL COST TAX CREDIT. Extends through the 2031 tax year the time that the Department of Agriculture may certify important agricultural lands qualified agricultural costs. Delays Taxpayers from claiming and applying the credit for at least three full taxable years after credit is earned, to help address State’s current fiscal concerns.

RELATING TO THE BOARD OF AGRICULTURE. Adds a member of the Hawaiian Homes Commission to the Board of Agriculture.

RELATING TO AGRICULTURAL BUILDINGS. Increases the maximum area for each agricultural shade cloth structure, cold frame, and greenhouse that could qualify the structure for an exemption from building permit and building code requirements.

RELATING TO INSPECTION FEES. Increases the inspection, quarantine, and eradication service fee and charge from 75 cents to $1.50 for every 1,000 pounds of freight or part thereof brought into the State.

RELATING TO THE ANIMAL INDUSTRY SPECIAL FUND. Adding new sources of revenue generated by the State Veterinary Laboratory and Animal Disease Control Branch that can be deposited into the animal Industry Special Fund.

RELATING TO ANIMAL CONTROL SERVICES. Repeals the requirement that the County of Kauai contract solely with the Kauai Humane Society for the provision of animal control services.

RELATING TO MICROCHIP IDENTIFICATION. Requires dog and cat owners to microchip their pets, if the pets are not licensed.

RELATING TO SECTION 711-1109, HAWAII REVISED STATUTES. Prohibits certain restraints and tethers that endanger, or deny sustenance, to a dog. Authorizes the court to assess fines, order performance of community service, require mental health counseling, or order attendance at educational classes concerning animal abuse prevention in addition to or in lieu of other penalties.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be able to testify. However, all written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
The House will not be responsible for bad connections on the testifier's end.
