Amends certain land subdivision and condominium property regime laws related to agricultural land, as recommended pursuant to Act 278, Session Laws of Hawaii 2019, to ensure certain condominium property regime projects within the agricultural district are used for agricultural purposes. RELATING TO OPERATING A VEHICLE UNDER THE INFLUENCE OF AN INTOXICANT. Establishes a state drug and alcohol toxicology testing laboratory special fund, to be administered by DOH. Deposits into the special fund fines imposed on offenders convicted of certain offenses involving operation of a vehicle under the influence of an intoxicant. Requires expenditure reports to the legislature. Effective 5/6/2137. (SD2)

RELATING TO THE PROTECTION OF SHARKS. Establishes an offense of intentionally or knowingly capturing, entangling, or killing a shark in state marine waters, and provides penalties and fines. Provides certain exemptions. Allows the department of land and natural resources to establish rules. Effective 1/1/2022. (SD2)

RELATING TO EDUCATION. Makes an emergency appropriation for fiscal year 2020-2021 from elementary and secondary school emergency relief fund (ESSER funds) moneys received by the State from the Coronavirus Aid, Relief, and Economic Security Act and the Coronavirus Response and Relief Supplemental Appropriations Act to offset any budget reductions that are identified or proposed by the department of education and the governor that would result in the reduction of personnel who are subject to a collective bargaining agreement pursuant to Chapter 89, Hawaii Revised Statutes, and who are employed at the school level, including any budget reduction that would result in a layoff, furlough, or pay reduction. Requires the Board of Education and superintendent of education to certify in writing that the Board of Education, superintendent, and department of education agree to certain conditions, including that the funds appropriated shall be used only for salaries and wages of officers and employees who are subject to a collective bargaining agreement and are employed at the school level in the classroom. Makes an appropriation for fiscal years 2021-2022 and 2022-2023 from the same source of funding and with the same conditions. Parts I, III, and IV effective 7/1/2051. Part II effective 5/1/2050. RELATING TO STATE GOVERNMENT. Abolishes the office of aerospace development (OAD), aerospace advisory committee, and the Hawaii unmanned aerial systems test site advisory board. Transfers administration of the Pacific international space center for exploration systems (PISCES) from DBEDT to the University of Hawaii at Hilo. Transfers the administration of the Challenger center Hawaii program (CCHI) from OAD to the department of education (DOE). Transfers appropriations for CCHI from OAD to DOE. Prohibits holdover board members of the Hawaii Tourism Authority (HTA). Specifies that moneys in the tourism emergency special fund are to be used exclusively for emergency measures. Requires that the 3.5 per cent cap on spending from the tourism special fund include all governance and employment expenses as administrative expenses. Repeals the allocation from transient accommodations tax to the tourism and tourism emergency special funds. Repeals HTA authorization to establish an advisory group. Requires the Governor to fix the compensation for the Hawaii Workforce Development Council's (Council) executive director and requires the Department of Labor and Industrial Relations (DLIR) to provide support staff. Clarifies the employment of professional staff by the public utilities commission. Transfers Hawaiian cultural duties and responsibilities to the State Foundation on Culture and the Artis (SFCA) and appropriates funds. Mandates that HTA work with SFCA for its marketing. Makes appropriation for HTA. Effective 7/1/2050. (SD2)

RELATING TO MILITARY DEPENDENTS. Exempts dependents of military service members from state residency requirement for government employment if the military service member is in Hawaii on bona fide military orders. Allows a spouse of an active duty service member in the military who accompanies the service member a permanent change of station to Hawaii and holds a current, unencumbered license in another jurisdiction in specific professions to apply for licensure on an expedited basis in the State. Effective 1/1/2022. (SD2)

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW. Authorizes the Director of Labor and Industrial Relations to prohibit the operation of pressure retaining items, amusement rides, and elevators and kindred equipment if inspection fees or fines are not timely paid. Deletes the statutory boiler and elevator fee schedule and requires the director to establish the fees by rules adopted pursuant to chapter 91, Hawaii Revised Statutes. Defines "amusement ride", "permit to operate", and "pressure retaining item". Replaces "boiler, pressure systems" with "pressure retaining items" throughout chapter 397, Hawaii Revised Statutes. RELATING TO THE TAKING OF NATURAL RESOURCES. Clarifies that any conservation and resources enforcement officer of the Department of Land and Natural Resources may, in the performance of their official duties, stop and temporarily detain any person whom the officer reasonably believes is, or recently has been engaged in, hunting or fishing for a natural resource inspection. Establishes civil administrative penalties for refusing to comply with an inspection request and specifies that the penalties do not apply to persons exercising constitutionally protected traditional and customary Native Hawaiian rights. RELATING TO COMMERCIAL DRIVER'S LICENSES. Clarifies the validity period for a commercial learner's permit. Adds a requirement for certain commercial driver's license applicants to complete an entry-level driver training course before taking other required tests for licensure. (SD2)

RELATING TO GOVERNMENT. Establishes a state government realignment commission to periodically review the state executive branch's departments, divisions, and agencies, including functions and services, and submit its findings and recommendations to the legislature. Appropriates American Rescue Plan Act funds for various broadband infrastructure installation and updates throughout the State and requires an annual report regarding these projects. RELATING TO THE ENVIRONMENT. Requires the clean water branch to perform water quality testing during brown water advisories as practicable and inform the public of health risks associated with water runoff during brown water advisories. Requires the department of health to consider environmental justice issues when making certain assessments and determinations. Appropriates funds for positions within the department of health.
