RELATING TO INCREASING THE OFFICE OF HAWAIIAN AFFAIRS' PRO RATA SHARE OF PUBLIC LAND TRUST FUNDS.

Establishes $           as the Office of Hawaiian Affairs' pro rata share of the public land trust.  Transfers $           less certain funds to the Office of Hawaiian Affairs for underpayment of the public land trust funds for 7/1/2012 to 6/30/2019.  Requires the Director of Finance to make up the difference between a specified minimum amount and an amount of public land trust receipts from an agency to the Office of Hawaiian Affairs by transferring the difference into the carry-forward trust holding account.  Requires the Department of Land and Natural Resources to provide an annual accounting of receipts from lands described in section 5(f) of the Admission Act.  Establishes a committee to recommend the annual amount of the income and proceeds from the public land trust that the Office of Hawaiian Affairs shall receive annually.  Appropriates funds.  (SD1)

RELATING TO AGRICULTURE.

Establishes the agricultural enforcement program and agricultural enforcement special fund within the Department of Agriculture.  Authorizes the Board of Agriculture and agricultural enforcement officers to exercise police powers.  Extends to the agricultural enforcement program the applicability of certain statutory provisions relating to the law enforcement officer independent review board; possession of electric guns; the law enforcement standards board; emergency vehicles; and worker's compensation for volunteer emergency response personnel.  Authorizes the use of funds in the agricultural development and food security special fund for protection of agricultural resources.  Appropriates funds.  (SD1)

Authorizes the Department of Agriculture to plan, design, construct, operate, manage, maintain, repair, demolish, and remove infrastructure on any lands under the jurisdiction of the department, to support and promote agriculture.  Establishes the agricultural enterprise program.  Establishes the Agricultural Enterprise Special Fund.  Requires the Board of Agriculture to annually report an accounting of non-agricultural park lessees to the Legislature.  Makes an appropriation.  (SD1)

Requires DOA to establish a permanent hemp program pursuant to federal law, and a corresponding special fund.  Requires DOH to adopt rules for the licensing, inspection, and regulation of industrial hemp processing facilities.  Reduces or repeals certain regulatory provisions of existing hemp pilot program.  Establishes authorized cultivation of hemp as affirmative defense.  Excludes hemp from the definition of marijuana.  Requires chairperson of board of agriculture to prepare a state plan for approval of the federal Secretary of Agriculture and report on the approval process to legislature and governor.  Appropriates funds.  Takes effect 7/1/2050.  (SD1)

RELATING TO THE STATE FIRE COUNCIL.

Authorizes the State Fire Council to use moneys in the reduced ignition propensity cigarette program special fund to support the duties and responsibilities of the state fire council.  Specifies the testing procedures of the reduced ignition propensity cigarette program.  Provides that a manufacturer of cigarettes that fail certain testing may be subject to civil penalties.

RELATING TO CERTAIN PENALTIES FOR VIOLATIONS OF SUBTITLE 4.

Amends fines for destroying or harvesting trees or tree products, including koa, on state forest reserves lands to an amount up to $10,000 or three times the market value at the time and place of the violation for each tree, whichever is greater, in addition to any costs associated with restoration or replacement of the habitat and damages to public land or natural resources, or any combination thereof.  Clarifies that any person violating any provision of part II (Forest Reserves) of chapter 183, Hawaii Revised Statutes, or any rule adopted pursuant thereto, other than section 183-17, Hawaii Revised Statutes, shall be guilty of a petty misdemeanor.  Decriminalizes traffic infractions within forest reserves and sets fine amounts.  Repeals the general penalty provision of section 183-4, Hawaii Revised Statutes.  Takes effect 12/31/2050.  (SD1)

Requires that any person who is eligible to vote and applies for a new or renewal motor vehicle driver's license, provisional license, or instruction permit, or a new, renewal, or duplicate identification card be automatically registered to vote if that person is not already registered to vote unless the applicant affirmatively declines to be registered to vote.  Authorizes access to and electronic transmission of databases maintained or operated by the counties or the department of transportation containing driver's license or identification card information to election officials and the statewide voter registration system.  Effective 1/1/2021.

Requires that e-liquid and electronic smoking devices be included within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law.  Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes and tobacco products.  Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products.  Allocates a portion of funds collected on excise taxes on tobacco products to fund health education, prevention, and nicotine cessation programs for youth, regarding the risks and dangers of the use of electronic smoking devices.  Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices.  Effective 9/1/2020.  (SD1)

RELATING TO CHILD SUPPORT.

Requires certain amounts of child support moneys collected by the Department of Human Services (DHS) for public assistance of a child to pass through to the family receiving public assistance.  Requires DHS to disregard passed through child support payments when calculating the income of an applicant for or recipient of public assistance.  Increases the maximum fine for an employer who discharges from employment, refuses to employ, or takes disciplinary action against any noncustodial parent subject to income withholding or who fails to comply with an order of assignment of future income to pay child support. Appropriates funds.  Effective 7/1/2021.  (SD1)

Allows the Hawaiian homes commission or the department of Hawaiian home lands to retain independent legal counsel as needed.  Authorizes the Hawaiian homes commission and the department of Hawaiian home lands to use the services of the attorney general as needed and when the interests of the State, Hawaiian homes commission, and department of Hawaiian home lands are aligned.  Provides that funds paid to independent legal counsel shall be paid by the State.

Repeals several exemptions from the prohibition on operating a pickup truck with a passenger seated in the bed or load-carrying area, including the exemption that allows passengers over twelve years of age to ride in the bed or load-carrying area.  Reduces the fine for violating the prohibition.  (SD1)

Requires a transition to silent, clean electric mopeds by prohibiting a retailer from selling or offering for sale combustion engine-powered mopeds beginning January 1, 2022.  Effective January 1, 2025.  (SD1)
