Establishes a comprehensive application process for executive pardons.

Amends Act 281, Session Laws of Hawaii 2019, to provide clarification and flexibility in eyewitness identification procedures.

RELATING TO DOMESTIC ABUSE.

Provides that family courts may withhold from public inspection any record of a denied temporary restraining order or denied protective order; provided that these records shall remain accessible to law enforcement without a court order.

RELATING TO SEXUAL ASSAULT EVIDENCE COLLECTION KITS.

Extends the deadline for each county police department to adopt and utilize an electronic tracking system for sexual assault evidence collection kits.

RELATING TO MONETARY BAIL.

Prohibits courts from requiring a monetary bail as a condition for release when a person is charged with a petty misdemeanor, a traffic violation, or an equivalent offense under county ordinance, except under certain circumstances.

      Status & Testimony

RELATING TO A DOMESTIC VIOLENCE OFFENDER REGISTRY.

Creates a domestic violence offender registry that is maintained by the Attorney General and accessible by the public.  Requires covered offenders to register and annually renew their registration for 15 years, or for life if convicted of a class A felony domestic violence offense.  Establishes a class C felony offense for failing to register or for providing false information during the registration process.  Requires county police chiefs to maintain a local registry of covered offenders and forward this information to the Attorney General.

SB 2638

      Status & Testimony

RELATING TO DOMESTIC VIOLENCE.

Amends the offense of abuse of family or household members to provide for misdemeanor and petty misdemeanor penalties.  Allows a deferred acceptance of guilty or no contest plea in misdemeanor and petty misdemeanor abuse penalties.  Requires the Judiciary to submit annual reports to the Legislature on the number and outcome of abuse of family or household members cases.  Sunsets five years after enactment.
