RELATING TO PUBLIC LANDS. Clarifies that lands set aside to the HHFDC by the governor or leased to the corporation by other state departments and agencies are excluded from the definition of "public lands" and require approval from the legislature upon disposition. Requires that lands set aside by the governor or leased to the HHFDC be returned to the public trust or to the leasing agency if the HHFDC is no longer needed by the HHFDC. (SD1)

RELATING TO INCLUSIONARY ZONING. Prohibits any law, ordinance, or rule from imposing an inclusionary zoning requirement on housing offered exclusively for sale in perpetuity to buyers who are residents of the State, are owner-occupants, and do not own any other real property. Requires each county to submit a report on inclusionary zoning requirements to the legislature every year until the regular session of 2025. Repeals the Act on 7/1/2025. (SD1)

RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Clarifies the meaning of "program or activity receiving state financial assistance". Excludes cases within the scope of the Individuals with Disabilities Education Act from the jurisdiction of the Hawaii civil rights commission.

RELATING TO SEXUAL ASSAULT EVIDENCE COLLECTION KITS. Extends the deadline for each county police department to adopt and utilize an electronic tracking system for sexual assault evidence collection kits.

RELATING TO MINORS. Expands conditions for a minor to consent to no-cost emergency shelter and related services, establish certain requirements by a shelter, and requires effort to leave a shelter for minors on each island. (SD1)

RELATING TO TEMPORARY RESTRAINING ORDERS, PROTECTIVE ORDERS, AND INJUNCTIONS. Clarifies that the effective period of a protective order, temporary restraining order, or injunction restraining any party from contacting, threatening, or physically abusing a minor may extend to a date after the minor has reached 18 years of age.

RELATING TO CRIMINAL JUSTICE. Requires all state correctional facilities to allow family members to engage in contact visitation with inmates at any state correctional facility during official visiting hours. Provides that the correctional facility shall provide each inmate with the opportunity for a minimum of two in-person, contact visits per week, with each visit lasting at least one hour. (SD1)

RELATING TO EDUCATION DATA. Requires the Department of Education to establish a standardized data collection process; collect and analyze data relating to, among other things, student discipline, seclusion, and restraint, school climate, and student achievement; and annually report certain information to the Board of Education, Legislature, and the public. RELATING TO CHILD ABUSE REPORTING. Adds members of the clergy, commercial computer technicians, commercial film and photographic print or image processors, and persons employed by organizations that have direct contact with or supervision of children to the categories of persons who are required to report child abuse and neglect to the Department of Human Services or to police. Provides a "safe harbor" through December 31, 2020, for reporting by clergy of known or suspected child abuse that was previously unreported and that did not arise during a penitential communication. RELATING TO MONETARY OBLIGATIONS. Prohibits the imposition of restrictions on a person's ability to obtain or renew a driver's license or to register, renew the registration of, or transfer or receive title to a motor vehicle, as a consequence of unpaid monetary obligations. Does not affect driver's license suspensions related to excessive speeding, lack of motor vehicle insurance, or non-compliance with a child support order.

RELATING TO THE MENTAL HEALTH OF DEFENDANTS. Permits judicial discretion for referral to a diversion program or treatment court should the defendant have serious and persistent mental health illness. (SD1)

RELATING TO DOMESTIC VIOLENCE. Amends the offense of abuse of family or household members to provide for misdemeanor and petty misdemeanor penalties. Allows a deferred acceptance of guilty or no contest plea in misdemeanor and petty misdemeanor abuse penalties. Requires the Judiciary to submit annual reports to the Legislature on the number and outcome of abuse of family or household members cases. Sunsets five years after enactment. (SD1)

RELATING TO TOWING. Clarifies meaning of existing statute relating to towing of abandoned vehicles by adding definitions; requires tow and storage companies to accept credit cards; includes penalties consistent with unfair practices per chapter 480, Hawaii Revised Statutes. (SD1)

RELATING TO CHILD SUPPORT ENFORCEMENT. Establishes that every judgment for child support is enforceable until paid in full.

RELATING TO SPECIAL IMMIGRANT JUVENILE STATUS. Specifies that the family court has jurisdiction in proceedings concerning the custody or guardianship of an immigrant child pursuant to a motion for Special Immigrant Juvenile factual findings requesting a determination that the child was abused, neglected, or abandoned before the age of 18.

RELATING TO AGRICULTURAL BUILDINGS. Grants county agencies the right to enter property to investigate agricultural buildings and structures for violations of and compliance with building code exemption qualifications.
