RELATING TO THE PENAL CODE. Establishes the offense of unauthorized attachment of an object to a fence, gate, wall, or other structure, which is committed when a person knowingly attaches an object to a fence, gate, wall, or other structure or barrier without the owner's permission.

RELATING TO THE SEXUAL ASSAULT OF AN ANIMAL. Amends the Penal Code to establish the crime of sexual assault of an animal. Provides that the sexual assault of an animal is a class C felony or a class B felony if the offense subjects a minor to sexual contact with an animal or is committed in the presence of a minor.

RELATING TO SEX TRAFFICKING. Removes the criminal statute of limitations for sex trafficking and promoting prostitution. Specifies that sex trafficking of a minor is a strict liability offense. Repeals the offense of solicitation of a minor for prostitution.

RELATING TO COVERED OFFENDER REGISTRATION. Repeals provision that allows persons designated as covered offenders in another state or jurisdiction to petition the Attorney General for termination of registration requirements upon demonstrating that the out of state convictions are not covered offenses in the State of Hawaii. (Proposed SD1).

RELATING TO THE CHILD PROTECTIVE ACT. Requires the court to appoint counsel to indigent parents and make every effort to do so at the first hearing attended by the parent.

RELATING TO DECLARATORY JUDGMENTS. Prohibits declaratory judgments when there is a cause of action and in other certain instances. Requires a plaintiff to show a personal stake in the actual controversy beyond a general disagreement or complaint by requiring a showing of an injury-in-fact.

RELATING TO THE LANDLORD-TENANT CODE. Prohibits landlords from recovering possession of a dwelling unit from tenants if habitability of the premises is significantly impaired. Sets a tenant's liability for rent if habitability of the premises is significantly impaired. Provides remedies for retaliatory evictions.

RELATING TO PARTITION ACTIONS. Requires commissioners in partition actions to file reports with the court and fully inform all interested parties of any intended applications to be filed with any department, state agency, or county to carry out the partition or division of real property, including water meter permits. Requires commissioners to provide interested parties the right to object to the report and be heard at a hearing. Requires commissioners to file a report with the court including proposed language of any deed of partition or of sale.

RELATING TO PENAL LIABILITY FOR BUSINESS ENTITIES. Requires a court to order the charter of a corporation forfeited and the certificate authorizing a foreign corporation to do business in the State revoked upon a felony or misdemeanor conviction of the corporation or its high managerial agent that is related to its business affairs. Repeals the requirement for findings for a court to order forfeiture of a charter or revocation of a certificate. Requires similar penalties for various partnership entities and limited liability companies and their foreign counterparts convicted of a felony or misdemeanor. Permits the winding up of the business.

RELATING TO EQUAL ACCESS TO PUBLIC CONVENIENCES. Requires that restrooms and toilet facilities of public amusement facilities constructed, renovated, retrofitted, or installed after 1/1/2021 have 2 female-use toilets for each male-use toilet or urinal.

RELATING TO LOBBYISTS. Requires lobbyists and specified individuals to file two additional reports to the Hawaii State Ethics Commission, including one report on the second Friday in August and one report on the first Monday in November in general election years, similarly to the filing frequency that candidates and the treasurer of candidate committees are required to file pursuant to section 11-334, Hawaii Revised Statutes.

RELATING TO CAMPAIGN FINANCE REPORTS. Clarifies that preliminary primary and preliminary general reports are due 10 days before the primary or general election.

RELATING TO ELECTIONEERING COMMUNICATIONS. Amends the definition of "disclosure date" to mean the date on which the electioneering communication is publicly distributed. Expands the definition of "electioneering communication" to apply to advertisements sent by any mail rate and communications regarding expenditures of the organization. Makes a conforming statutory amendment relating to the determination of the date by which a person is deemed to have made a campaign expenditure.

RELATING TO ELECTIONS. Makes housekeeping amendments to elections laws to clarify the administration of elections by mail.

RELATING TO ELECTIONS. Includes agents of candidates listed on ballots among the persons prohibited from providing voting assistance at voter service centers and in the use of absentee ballots.

RELATING TO STATUTORY REVISION: AMENDING OR REPEALING VARIOUS PROVISIONS OF THE HAWAII REVISED STATUTES OR THE SESSION LAWS OF HAWAII FOR THE PURPOSES OF CORRECTING ERRORS AND REFERENCES, CLARIFYING LANGUAGE, OR DELETING OBSOLETE OR UNNECESSARY PROVISIONS. Amends or repeals various provisions of the Hawaii Revised Statutes or the Session Laws of Hawaii for the purposes of correcting errors and references, clarifying language, or deleting obsolete or unnecessary provisions.
