RELATING TO AN UNDERWATER TUNNEL AND SUPPORTING ROADWAYS TO PROVIDE A MORE DIRECT CONNECTION BETWEEN EWA AND DOWNTOWN HONOLULU. Requires the Department of Transportation to conduct a study on the feasibility of a private-public partnership to design, build, and operate an underwater tunnel for vehicle traffic to provide a more direct connection between Ewa and downtown Honolulu along with the expansion of roadways as necessary to maximize use of the tunnel. Appropriates funds. Effective 7/1/2050.

RELATING TO HOMELAND SECURITY. Establishes the Hawaii state fusion center as a program under the office of homeland security and establishes the position of Hawaii state fusion center director who shall be state-funded, responsible to the director of homeland security, and accountable to manage the operations of the center. RELATING TO THE UNIVERSITY OF HAWAII. Appropriates funds to provide scholarships to students pursuing Hawaiian language certifications or degrees within the University of Hawaii system. Takes effect on 7/1/2050.

RELATING TO THE ENVIRONMENT. Requires agencies allotted a portion of the environmental response, energy, and food security tax to consider actions in achieving the zero emissions clean economy target and climate change resilience. Requires these agencies to report on how expenditures from these special funds support achieving the zero emissions clean economy target and climate change resilience. Effective 7/1/2050. (HD1)

RELATING TO SOLID WASTE MANAGEMENT. Requires residential and commercial solid waste be separated by source and processed at appropriate facilities. Requires each county to submit a revised integrated solid waste management plan by 1/1/2021. Establishes a 2030 waste stream reduction goal. Appropriates funds to the counties for solid waste management programs. Effective 7/1/2050.

RELATING TO HYDROFLUOROCARBONS. Establishes regulations on the use of hydrofluorocarbons in state law. Phases out hydrofluorocarbons in favor of alternatives with lower global warming potential. Establishes a preference for products that do not contain hydrofluorocarbons in the state procurement code. Directs the Hawaii State Energy Office and the Environmental Management Division of the Department of Health to study how to increase the use of refrigerants with low global warming potential, reduce the use of hydrofluorocarbons, and recommend how to fund, structure, and prioritize a state program that incentivizes or provides grants to support the elimination of legacy uses of hydrofluorocarbons. Appropriates funds for the study to be performed by the Hawaii State Energy Office. Effective 7/1/2050.

RELATING TO NONDEPOSITORY TRUSTS. Clarifies the powers and duties of nondepository trust companies. Amends the yearly assessment on nondepository trust companies by basing its calculation on total assets under management. Establishes a paid-in capital and surplus requirement for chartering nondepository trust companies. Effective 7/1/2050.

RELATING TO MASSAGE THERAPY. Requires the Board of Massage Therapy to adopt and enforce sanitation rules for massage establishments. Repeals existing statutory language that classifies unlicensed activity as a petty misdemeanor in favor of existing statutes that treat unlicensed activity as a misdemeanor. Increases the minimum fine from $100 to $250 and the maximum fine from $1,000 to $2,000 for each violation of the massage therapy laws. Effective 7/1/2050.

RELATING TO A BANK OF THE STATE OF HAWAII. Directs the Department of Commerce and Consumer Affairs to conduct a comprehensive review of relevant state laws to develop legislation to establish a state-operated bank of the State of Hawaii. Appropriates funds to conduct the review. Effective 7/1/2050.

RELATING TO THE TRANSITION OF THE OAHU REGIONAL HEALTH CARE SYSTEM FROM THE HAWAII HEALTH SYSTEMS CORPORATION INTO THE DEPARTMENT OF HEALTH. Sets a date of 6/30/2022 for the transition of the Oahu regional health care system facilities from the Hawaii health systems corporation to the department of health. Establishes a working group to develop a comprehensive plan that addresses necessary components of such transition. Takes effect on 7/1/2050. Part II takes effect on 1/1/2050.

RELATING TO COMMUNITY CARE FOSTER FAMILY HOMES. Increases the number of hours the primary caregiver may be absent from a community care foster family home; provided that a substitute caregiver is present. Effective 7/1/2050.

RELATING TO MEDICAID BENEFITS. Appropriates funds to restore diagnostic, preventive, and restorative dental benefits to adult Medicaid enrollees, provided DHS obtains maximum federal matching funds available. Takes effect on December 31, 2059.

RELATING TO HEALTH. Repeals the ceiling for using moneys in the civil monetary penalty special fund by DOH for compliance activities approved by the Centers for Medicare and Medicaid Services. Appropriates funds to DOH for the establishment of a medicare administrator position. Effective 7/1/2050.

RELATING TO PHYSICIAN SHORTAGE. Addresses the State's physician shortage by establishing a Medical Student Sponsorship Program within DOH for medical students who successfully graduate from a high-quality but lower-cost school of medicine and make a ten-year service commitment to practice medicine in Hawaii. Appropriates funds. Effective 7/1/2050.

RELATING TO THE YOUTH VAPING EPIDEMIC. Beginning 1/1/2021: bans the sale of flavored tobacco products; prohibits mislabeling of e-liquid products containing nicotine; and establishes fines and penalties for violations. Requires the Department of Education to establish a safe harbor program by which persons under 21 years of age may dispose of electronic smoking devices in their possession. Requires public school teachers and educators to confiscate electronic smoking devices. Increases fines for the purchase or possession of tobacco products and electronic smoking devices by persons under 21 years of age. Authorizes a court to impose, as a penalty on a person 18-21 years of age who is convicted of possession of a tobacco product or electronic smoking device, the requirement to complete a tobacco education program, complete a tobacco use cessation program, or perform community service instead of paying a fine. Effective 7/1/2050.

RELATING TO CHILD SUPPORT. Requires the AG to convene a study group to examine the impacts, costs, and impediments of allowing child support payments to pass through to TANF recipients and submit a report to the legislature prior to the 2021 Regular Session. Effective 12/31/2059.

RELATING TO LAND RECORDATION. Clarifies the data requirements for land recordation on land deregistered by the land court other than fee simple time share interests. Effective 7/1/2050.

RELATING TO DEVELOPMENT DISTRICTS. Establishes the Pulehunui community development authority on the island of Maui as an autonomous community development authority under the Hawaii Community Development Authority for the purposes of developing the Pulehunui community development district. Authorizes the Hawaii Community Development Authority to obtain various forms of financial aid from the federal government for projects of the authority. Appropriates funds for the development of the Pulehunui community development district and establishment of two full-time equivalent (2.00 FTE) positions. Effective 7/1/2050.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT. Prohibits lessees who sell or transfer land from obtaining subsequent leases of the same class of land unless the subsequent lease is acquired pursuant to section 209 of the Hawaiian Homes Commission Act, 1920, as amended, or the prior lease interest held by the lessee was a partial interest held with another lessee or lessees. Effective 7/1/2050.

RELATING TO AUTHORIZING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO LEASE PASTURE LANDS ON TERMS THAT PROMOTE COLLABORATIVE BENEFICIAL USE FOR FORESTRY, WILDLIFE, RECREATIONAL, AND FOOD PRODUCTION PURPOSES. Authorizes the Board of Land and Natural Resources to amend and extend existing pasture leases and to issue new pasture leases by negotiation in furtherance of public purposes. Requires DLNR and DOA to identify potentially transferable lands whose land use classification is at dispute and petition the land use commission for a determination. Effective 7/1/2050.

RELATING TO EMPLOYEES' RETIREMENT SYSTEM DISABILITY RETIREMENT. Clarifies the employees' retirement system's eligibility requirement definitions for service-connected disability and accidental death benefits. Effective 1/1/2050.
