RELATING TO MASSAGE THERAPY.

Requires the Board of Massage Therapy to adopt and enforce sanitation rules for massage establishments.  Repeals existing statutory language that classifies unlicensed activity as a petty misdemeanor in favor of existing statutes that treat unlicensed activity as a misdemeanor.  Increases the minimum fine from $100 to $250 and the maximum fine from $1,000 to $2,000 for each violation of the massage therapy laws.  Effective 7/1/2050.  (HD1)

RELATING TO PROFESSIONAL AND VOCATIONAL LICENSING TRUST FUNDS.

Allows the contractors license board and real estate commission to adjust, reduce, suspend, or cease collection of recovery fund and education fund fees to maintain a reasonable relation between the fees generated and the cost of services rendered by the funds.  Caps the contractors recovery fund, contractors education fund, real estate recovery fund, real estate education fund, and condominium education trust fund at amounts determined biannually by the contractors license board or real estate commission.  Effective 7/1/2050.  (HD3)

RELATING TO NONDEPOSITORY TRUSTS.

Clarifies the powers and duties of nondepository trust companies.  Amends the yearly assessment on nondepository trust companies by basing its calculation on total assets under management.  Establishes a paid-in capital and surplus requirement for chartering nondepository trust companies.  Effective 7/1/2050.  (HD1)

Limits the period of DOH commitment for those defendants charged with a non-violent class C felony and found to be unfit to proceed under chapter 704, HRS.  Effective 7/1/2050.  (HD2)

RELATING TO THE ADMINISTRATION OF JUSTICE.

Amends the effect of finding a defendant charged with a petty misdemeanor not involving violence or attempted violence unfit to proceed.  Amends the requirements for fitness determination hearings, court-appointed examiners, and examination reports.  Authorizes the courts to enter into agreements to divert into residential, rehabilitative, and other treatment those defendants whose physical or mental disease, disorder, or defect is believed to have become or will become an issue in a judicial case.  Amends the requirements for appointing qualified examiners to perform examinations for penal responsibility.  Requires an examination for penal responsibility to be conducted within fifteen days after a finding of fitness to proceed.  Effective 7/1/2050.  (HD2)

Clarifies the meaning of "program or activity receiving state financial assistance".  Excludes cases within the scope of the Individuals with Disabilities Education Act from the jurisdiction of the Hawaii civil rights commission.  Effective 12/31/2059.  (HD2)

RELATING TO AUDITORY DEVICES.

Exempts gross receipts from the sale of auditory devices, such as hearing aids, from the general excise tax.  Amends the definition of "prosthetic device" to include hearing aids and devices worn on the body.  Exempts gross receipts from the repair of prosthetic devices from the general excise tax.  Effective 7/1/2050.  (HD1)

Amends the statewide newborn hearing screening program to require reporting of diagnostic audiologic evaluation results of infants who do not pass the hearing screening test to DOH to improve hearing follow-up treatment and support of infants.  Updates definitions and terminology.  Effective 7/1/2050.  (HD2)
