RELATING TO AGRICULTURE. Establishes the agricultural theft enforcement program and agricultural theft enforcement special fund within the Department of Agriculture. Authorizes the Board of Agriculture and agricultural theft enforcement officers to exercise police powers. Extends to the agricultural theft enforcement program the applicability of certain statutory provisions relating to the law enforcement officer independent review board; possession of electric guns; the law enforcement standards board; emergency vehicles; and worker's compensation for volunteer emergency response personnel. Authorizes the use of funds in the agricultural development and food security special fund for protection of agricultural resources. Appropriates funds.

RELATING TO AGRICULTURAL THEFT AND VANDALISM PILOT PROJECT. Appropriates additional funding for the two-year agricultural theft and pilot project pursuant the Act 217, Session Laws of Hawaii (2019).

RELATING TO COFFEE LABELING. Expands the coffee labeling and advertising requirements to include ready-to-drink coffee beverages and inner wrapping or packaging labels. Effective 7/1/2021.

RELATING TO INTOXICATING LIQUOR. Exempts applications for a class 1 license on land designated as agricultural by state or county zoning laws and for which the majority of the agricultural products used in the manufacturing of the liquor are grown and produced in the State by the license holder from the automatic refusal provision that may be invoked by a majority of nearby voters or real estate owners.

RELATING TO LIQUOR LAWS. Exempts applications for a class 1 manufacturer license on land designated as agricultural by state or county zoning laws if the majority of the agricultural products used in the manufacturing of the liquor are grown and produced in the State by the applicant from mandatory refusal provisions.

RELATING TO AGRICULTURE. Extends the deadline for submitting the strategic plan required by Act 151, Session Laws of Hawaii 2019. Extends the lapse date for funds appropriated by the Act to 6/30/2021.

RELATING TO PESTICIDES. Establishes the Restricted Use Pesticide Disposal Amnesty Program within the Department of Agriculture to provide a one-time, affordable, and environmentally accessible means for the disposal of restricted use pesticides from a bona fide agricultural entity. Convenes a Restricted Use Pesticide Disposal Amnesty Program Steering Committee to guide and monitor the program. Appropriates funds.

RELATING TO PESTICIDES. Requires the Department of Agriculture to provide annual reporting on pesticide inspection and compliance investigations. Increases monetary fines for pesticide violations.

RELATING TO ANIMAL CRUELTY. Beginning 1/1/2021, prohibits the confinement of specified farm animals in a cruel manner and prohibits business owners and operators from selling certain products made from those animals.

RELATING TO MICROBEADS. Beginning 7/1/2021: bans the manufacture of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads. Beginning 7/1/2022: bans the sale or offer for sale of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads and bans the manufacture of a non-prescription drug that contains synthetic plastic microbeads. Beginning 7/1/2023: bans the sale or offer for sale of a non-prescription drug that contains synthetic plastic microbeads. Specifically exempts rinse-off cosmetics and rinse-off cosmetics that are also non-prescription drugs regulated by the federal Microbead-Free Waters Act of 2015.

RELATING TO ENVIRONMENTAL PROTECTION. Establishes a 3-year Department of Health pilot project to demonstrate new toilet and sewage treatment technologies and to expedite demonstration projects. Appropriates funds. Repeals on 6/30/2022.

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Defines "cultural assessment" and "cultural impact assessment". Requires cultural assessments to be available for public review and comment in connection with draft environmental assessments. Requires a cultural impact assessment if an agency determines a proposed action may have a significant effect on the environment.

RELATING TO INVASIVE SPECIES. Appropriates funds to the Department of Agriculture for its efforts to mitigate and control two-lined spittlebug infestations in the State.
