A BILL FOR AN ACT

 

 

relating to address confidentiality.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that on July 5, 2018, Governor David Ige signed into law Act 115, Session Laws of Hawaii 2018, known as the Address Confidentiality Act.  This law provides survivors of domestic abuse, sexual offenses, or stalking with a substitute address to be used by state and local government agencies instead of their physical address.  The substitute address may be used whenever an address is required for public records.  Mail is received at the substitute address and forwarded to the survivor's actual address.

     The legislature also finds that no moneys were allocated to support the program, and without additional funding, the office of the lieutenant governor's current budget is unable to absorb the start-up and day-to-day operational cost of maintaining the program.  Currently, the office of the lieutenant governor is preparing to implement the program, but unless necessary funding is available, the office of the lieutenant governor will be unable to carry out the program's objectives.

     Accordingly, the purpose of this Act is to appropriate funds for one full-time equivalent (1.0 FTE) position, operating costs, and equipment to administer the address confidentiality program pursuant to chapter 801G, Hawaii Revised Statutes.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $360,000 or so much thereof as may be necessary for fiscal year 2020-2021 for one full-time equivalent (1.0 FTE) position, operating costs, and equipment to administer the address confidentiality program pursuant to chapter 801G, Hawaii Revised Statutes; provided that $60,000 of the moneys appropriated pursuant to this Act shall be used to fund the salary of the one full-time equivalent (1.0 FTE) position.

     The sum appropriated shall be expended by the office of the lieutenant governor for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2020.
