Sir:
Your Committees on Judiciary and Public Safety, Veterans, & Military Affairs, to which was referred S.B. No. 2635, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO FIREARMS AMMUNITION,"
beg leave to report as follows:
The purpose of this measure is to:
(1) Prohibit any person from selling ammunition or shell casings for any firearm unless the purchaser first demonstrates that they are the registered owner of the firearm for which the ammunition or shell casings are to be purchased or have been designated by the registered owner of the firearm as an alternate for ammunition purchases;
(2) Authorize registered owners of firearms to designate a person as an alternate on the firearm registration only for the purpose of purchasing ammunition;
(3) Require licensure of sellers of ammunition;
(4) Regulate ammunition in the same manner as firearms; and
(5) Require the Attorney General to update firearm registration forms.
Your Committees find that requiring firearm owners to show their firearm registrations and identification in order to be able to purchase ammunition will limit the ability of those who possess firearms illegally to get ammunition.
Your Committees have amended this measure by:
(1) Exempting ammunition purchases by persons from a firing range business or target shooting business from the proof of registration and identification requirements;
(2) Deleting language authorizing the police departments of the county of registration to designate on the firearm registration form whether the firearm can be converted to a different caliber or gauge and to indicate on the registration form the types of ammunition for each caliber or gauge of ammunition that the firearm may lawfully use;
(3) Requiring a scanned copy of an online purchaser's registration and identification instead of receipt of a scanned copy;
(4) Requiring firearm registration forms to include a place for the registrant to designate an alternate person to purchase ammunition;
(5) Authorizing a registered owner of a firearm to designate an alternate person to purchase ammunition for up to three years at a time, unless the alternate person is prohibited from ownership or possession of a firearm;
(6) Allowing a registered owner of a firearm to obtain a permit, for up to three years at a time, to purchase ammunition of a caliber that is not the caliber listed on the registered firearm if the owner demonstrates to the police that the firearm is capable of firing a caliber of ammunition that is not the caliber listed on the registration of the firearm;
(7) Changing the effective date to July 1, 2021; and
(8) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the records of votes of the members of your Committees on Judiciary and Public Safety, Veterans, & Military Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 2635, S.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 2635, S.D. 2, H.D. 1, and be referred to your Committee on Finance.
