Sir:

 

     Your Committees on Judiciary and Consumer Protection & Commerce, to which was referred H.B. No. 583, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO CANNABIS FOR MEDICAL USE,"

 

beg leave to report as follows:

 

     The purpose of this measure is to better serve the needs and protect the safety of the State's seriously ill patients by:

 

     (1)  Clarifying the process for the voluntary or involuntary sale or transfer of a dispensary license;

 

     (2)  Removing the exclusion from dispensary employment for felony convictions;

 

     (3)  Repealing certain restrictions on medical cannabis dispensary siting; and

 

     (4)  Including primary caregivers, qualifying out-of-state patients, and caregivers of qualifying out-of-state patients as individuals able to access medical cannabis retail dispensing locations.

 

     Your Committees received testimony in support of this measure from the Department of Health, Hawaii Cannabis Industry Association, and one individual.  Your Committees received testimony in opposition to this measure from Maui Police Department, Patients Without Time, and one individual.

 

     Your Committees find this measure improves the State's medical cannabis dispensary law and helps fulfill the original intent of the program by clarifying provisions and implementing reasonable modifications to support patient access to medical cannabis and manufactured cannabis products.

 

     Your Committees have amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the records of votes of the members of your Committees on Judiciary and Consumer Protection & Commerce that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 583, H.D. 1,  as amended herein, and recommend that it be referred to your Committee on Finance, in the form attached hereto as H.B. No. 583, H.D. 2.
