Sir:

 

     Your Committee on Lower & Higher Education, to which was referred H.B. No. 2665 entitled:

 

"A BILL FOR AN ACT RELATING TO INTERCOLLEGIATE ATHLETICS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to statutorily establish the right of postsecondary student athletes in intercollegiate athletics to receive compensation for the use of their name, image, or likeness.

 

     Your Committee received testimony in opposition to this measure from the University of Hawaii's Athletic Departments at Manoa and at Hilo.

 

     Your Committee finds that postsecondary student athletes in intercollegiate athletics bring great value to the postsecondary institutions which they attend.  Your Committee further finds that because of their commitment to school and athletics, many student athletes are unable to find the time to work at a job and earn a wage to pay for school and other expenses.  In 2019, the State of California passed legislation that allows a student athlete in California to be provided compensation in relation to the student athlete's name, image, or likeness.  This measure will similarly allow student athletes in Hawaii to receive compensation for the use of their name, image, and likeness to help the student-athlete financially support themself so that they can focus on their academic and athletic endeavors.

 

     Your Committee has amended this measure by:

 

     (1)  Changing its effective date to July 1, 2050; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Lower & Higher Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2665, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2665, H.D. 1, and be referred to your Committee on Judiciary.
