Sir:

 

     Your Committee on Judiciary, to which was referred H.B. No. 2152, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO TRAFFIC VIOLATIONS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require additional circumstances under which every motor vehicle, including motorcycles, motor scooters, and motorized bicycles, moving on any public highway in Hawaii must display its lighted head lamps.

 

     Your Committee received testimony in support of this measure from the Department of Transportation.

 

      Your Committee finds that various conditions can result in poor visibility for drivers, especially during daytime hours when streetlights are not always on.  The use of a vehicle's headlights renders the vehicle more visible to others and increases the driver's ability to identify hazards around the vehicle.  This measure is an effort to improve traffic safety and reduce the number of deaths and injuries on Hawaii's roadways by requiring the use of lighted head lamps on motor vehicles in situations where visibility is limited.

 

     Your Committee has amended this measure by:

 

     (1)  Removing the continuous use of windshield wipers as a circumstance under which a motor vehicle must display its lighted head lamps; and

 

     (2)  Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2152, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 2152, H.D. 2.
