Sir:
Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 2000, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO COMMERCIAL MOTOR VEHICLES,"
begs leave to report as follows:
The purpose of this measure is to bring the State in substantial compliance with federal regulations by requiring the examiner of drivers to disqualify, for life, any person from driving a commercial motor vehicle if the person uses a commercial motor vehicle in the commission of any felony involving an act or practice of severe forms of trafficking in persons.
Your Committee finds that the
Federal Motor Carrier Safety Administration finalized administrative
regulations that permanently disqualify from driving a commercial motor vehicle,
individuals convicted of a felony involving a severe form of human trafficking
while operating a commercial motor vehicle.
These regulations became effective on September 23, 2019, and set a
deadline of three years for states to come into substantial compliance with the
regulations. This measure would put the
State in substantial compliance with the federal regulations.
As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2000, H.D. 1, and recommends that it be referred to your Committee on Judiciary.
