Sir:
Your Committee on Transportation, to which was referred H.B. No. 1833 entitled:
"A BILL FOR AN ACT RELATING TO PEER-TO-PEER CAR-SHARING,"
begs leave to report as follows:
The purpose of this measure is to authorize peer-to-peer car sharing in Hawaii.
Your Committee finds that peer-to-peer car-sharing programs have been shown to reduce traffic congestion and reduce greenhouse gas emissions because it encourages individuals to share access to cars rather than owning cars themselves. As this business model is markedly different from the traditional rental car model, the establishment of new regulations is necessary to address this emerging transportation industry.
Your Committee has amended this measure by:
(1) Removing language that limited liability for a peer-to-peer car-sharing program that maintained insurance coverage during the car-sharing period;
(2) Requiring that a peer-to-peer car-sharing program enter into a contract or other agreement with the Airports Division of the Department of Transportation pursuant to section 261-7(a), Hawaii Revised Statutes, prior to operating at any airport in Hawaii;
(3) Requiring a peer-to-peer car-sharing program to comply with all rules of the Airports Division of the Department of Transportation;
(4) Specifying what is included in the daily and periodic cost to the shared car driver and requiring the peer-to-peer car-sharing program to disclose any quotations of price as part of the car-sharing program agreement;
(5) Imposing a peer-to-peer car-sharing surcharge tax, which the peer-to-peer car-sharing program is responsible for collecting and remitting to the Department of Transportation for deposit into the state highway fund;
(6) Changing its effective date to July 1, 2050, to encourage further discussion; and
(7) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1833, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1833, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
