RELATING TO EMINENT DOMAIN. Requires the department of land and natural resources to acquire by eminent domain the seawall and the real property underneath the seawall that is located on or near the seaward boundaries of property between 2943 Kalakaua Avenue and 3019 Kalakaua Avenue. Appropriates funds to the department of land and natural resources for the just compensation of taking, and the repair and maintenance of the entire seawall and the real property under the seawall.

RELATING TO SMALL BOAT HARBORS. Authorizes the Board of Land and Natural Resources to transfer the operation, administration, management, and maintenance of the Kihei Small Boat Harbor, with some exceptions, to Kaho‘olawe Island Reserve Commission. Authorizes the Kaho‘olawe Island Reserve Commission to undertake those duties.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT. Requires the Department of Hawaiian Home Lands to digitize its applicant, beneficiary, and lessee records. Appropriates funds.

RELATING TO LAND RECORDATION. Specifies that the data requirements for land recordation by the Bureau of Conveyances, on land other than fee simple timeshare interests deregistered by the land court, shall include a map and description prepared by a licensed surveyor.

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY. Excludes lands set aside by the Governor to the Hawaii Public Housing Authority (HPHA) and lands to which HPHA holds title from the definition of public lands in section 171-2, Hawaii Revised Statutes. Requires prior legislative approval for the sale of lands to which HPHA holds title.

RELATING TO LIABILITY. Provides that the State or a county that repairs or maintains a street of which the ownership or jurisdiction is in dispute between the State and the county, shall be immune from liability for personal injuries or property damage arising out of the repair or maintenance of that street. Deems that maintenance of a street shall not confer ownership or jurisdiction over such street, if the ownership or jurisdiction over the street is in dispute between the State and the county.

RELATING TO AQUATIC RESOURCES. Establishes the Molokini special fund. Authorizes the Department of Land and Natural Resources to require commercial operators who conduct activities within the Molokini shoal to charge a user fee for each customer. Appropriates funds.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
If during the course of the hearing it appears there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three-minutes. This three-minute policy will be enforced to ensure fairness and adequate consideration to all bills.
