RELATING TO HEALTH.

Beginning January 1, 2020, requires the State's medicaid managed care and fee-for service programs to provide coverage for home and community-based services for individuals diagnosed as having autism or fetal alcohol spectrum disorder.  Requires the Department of Human Services to seek a section 1115 waiver to amend the state Medicaid plan to include this coverage.  (SD1)

RELATING TO THE NURSING FACILITY SUSTAINABILITY PROGRAM.

Extends the nursing facility sustainability fee program to 2021.  Allows the nursing facility sustainability fee to be used to enhance capitated rates for the purpose of paying quality incentives.  Increases the nursing facility sustainability fee limit from 4.0 per cent to 5.5 per cent of net patient service revenue.  Increases the per resident daily maximum fee from $13.46 to $20 for each facility, and increases the per resident reduced daily maximum fee from $5.85 to $9 for facilities that meet certain exceptions.  Appropriates funds.  (SD1)

RELATING TO PROPOSED CONSTITUTIONAL AMENDMENTS.

Requires the attorney general to prepare a statement for each proposed constitutional amendment in language that is clear and neither misleading nor deceptive that indicates the purpose, limitations, and effects of the proposed amendment.  Requires the attorney general to also prepare the statement in Hawaiian.  Requires the office of elections and county clerks to make the statement available to the public.  Makes an appropriation.  (SD1)

Establishes a Hawaii retirement savings program for private sector employees.  Establishes the Hawaii retirement savings program administrative fund.  Requires the department of budget and finance to prepare an annual report detailing the department's activities for the previous fiscal year to the governor and legislature.  Appropriates funds.  (SD1)

RELATING TO DISASTER PREPAREDNESS.

Prohibits the planting of large trees along evacuation routes and requires the Hawaii Emergency Management Agency to identify large trees along evacuation routes and trim, spray, or remove large trees if the trees have the potential to obstruct the evacuation route.  Defines evacuation route.  Appropriates funds.  Takes effect 7/1/2050.  (SD1)

Prohibits state and county law enforcement agencies from complying with federal immigration detainers or honoring requests for non-public information unless specifically required to do so by a warrant signed by a judge or provisions of federal, state, or local law.

RELATING TO RECYCLING.

Prohibits counties from rejecting number 1 and 2 plastic bottles presented for recycling solely because the bottles are accompanied by or adjoined to nonrecyclable bottle caps.  Requires and appropriates funds for the counties to separate and appropriately dispose of such nonrecyclable bottle caps.  Adds definition of "PP", or polypropylene plastic material, into integrated solid waste management law.  Requires counties to include feasibility assessment of recycling PP materials.

RELATING TO PLANNING.

Requires the State and counties to incorporate predictions of sea level rise and other climate change hazards and mitigation opportunities into applicable plans, strategies, and mapping. Requires the public utilities commission to consider the findings in the Hawaii Sea Level Rise Vulnerability and Adaptation Report.  Requires each county to participate in the community rating system developed by the National Flood Insurance Program.  (SD1)

Amends the definition of "bicycle" for the purposes of county vehicular taxes, highway safety laws, and Statewide Traffic Code by adding and defining low-speed electric bicycles and requiring that an operator of a low-speed electric bicycle be at least fifteen years of age.  (SD1)

RELATING TO THE KAHOOLAWE ISLAND RESERVE COMMISSION.

Appropriates funds to the Department of Land and Natural Resources for support of the Kahoolawe Island Reserve Commission, including two full-time equivalent (2.0 FTE) permanent positions.  Takes effect 12/31/2050.  (SD1)
