      Status & Testimony

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW.

Increases the fine that may be assessed, for campaign spending law violations, against a noncandidate committee making only independent expenditures and that has received at least 1 contribution of more than $10,000, or spent more than $10,000 in an election period.  Allows the Campaign Spending Commission to order that payment of a fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

RELATING TO ELECTIONS.

Allows the elections commission to refer a complaint to the attorney general or county prosecutor in addition to any administrative determination and without the requirement that the commission believes the respondent has recklessly, knowingly, or intentionally committed a violation.  Disqualifies a person convicted of violating elections criminal prosecution laws from holding elective public office for ten years, rather than four.  Repeals language stipulating that elections criminal prosecution law does not apply to any person who has paid or agreed to pay fines related to report filing violations and advertisement violations prior to the commencement of the proceedings.

RELATING TO ELECTIONS.

Requires the chief election officer, with assistance from the county clerks for elections involving county offices and countywide ballot issues, to publish and distribute a voters' pamphlet.  Appropriates moneys to allow the chief election officer to produce and distribute a voters' pamphlet for each election.

      Status & Testimony

RELATING TO PROFESSIONALLY LICENSED OR CERTIFIED GOVERNMENT EMPLOYEES.

Clarifies that the State shall be exclusively liable for claims for injury or loss of property, or personal injury or death, resulting from the negligent or wrongful act or omission of any professionally licensed or certified employee of the State while acting within the scope of the employee's office or employment.  Precludes civil actions or proceedings for money damages against the employee, except for claims based on liability other than an employee's scope of employment with the State or other employer.  Clarifies liability when the State agrees to assume full or partial responsibility in a civil action against a professional licensed or certified employee.

RELATING TO FALSE CLAIMS TO THE STATE.

Amends false claims statute, section 661-21 (a), Hawaii Revised Statutes, to increase civil monetary penalty minimum and maximum amounts to maintain consistency with federal law so that the State can continue to maximize it's recoveries in cases where State money is taken illegally and False Claims Act prosecution is successful.

RELATING TO TAX APPEALS.

Replaces the tax boards of review with a single tax appeal review panel comprised of members who shall devote full time to their duties.  Amends the grounds upon which an appeal to the administrative appeals and dispute resolution program may be made by disallowing appeals of proposed assessments.
