A BILL FOR AN ACT

 

 

relating to non-general funds.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that some administratively- or statutorily-established non-general funds have been altered, amended, repealed, or neglected and are effectively non­functional or no longer serve the purpose for which they were created.

     The legislature further finds that the balances languishing in those funds should be transferred to the general fund so that these moneys may be expended to benefit the people of Hawaii.

     The purpose of this Act is to abolish or repeal certain non-general funds that are no longer necessary, that no longer serve the purpose for which they were created, or for which the establishing authority has expired, and to deposit the unencumbered balances of those funds into the general fund.

     SECTION 2.  On June 30, 2019, the following funds shall be abolished or repealed:

     (1)                 ;

and any unencumbered balances shall lapse to the credit of the general fund.

     SECTION 3.  The director of finance shall identify any non-general funds that are abolished or repealed by this Act and that contain or receive deposits from any federal funding source and transfer the portions of those balances consisting of federal funds into corresponding separate special subaccounts within the general fund to enable the continuation of the purposes funded by the federal funding sources.

     SECTION 4.  It is the intent of this Act not to jeopardize the receipt of any federal aid nor to impair the obligation of the State or any agency thereof to the holders of any bond issued by the State or by any such agency, and to the extent, and only to the extent, necessary to effectuate this intent, the governor may modify the strict provisions of this Act, but shall promptly report the modification with reasons therefor to the legislature at its next session thereafter for review by the legislature.

     SECTION 5.  If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.

     SECTION 6.  This Act shall take effect upon its approval.
