A BILL FOR AN ACT

 

 

RELATING TO MENTAL HEALTH FACILITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 334, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§334-    Patients; electronic tracking devices.  (a)  A patient who is housed in a psychiatric facility, and who is authorized to remain unescorted outside that facility, and who has been:

     (1)  Adjudged not responsible for a felony offense on the ground of physical or mental disease, disorder, or defect pursuant to section 704-400; or

     (2)  Determined by a psychiatrist or psychologist to be likely to commit an act of violence;

shall at all times wear an electronic tracking device that is constantly monitored.

     (b)  As used in this section, "facility" includes a physical structure enclosed by walls and any area outside that structure that is enclosed by locked fencing."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 3000.
