A BILL FOR AN ACT

 

 

RELATING TO ADVANCED PRACTICE REGISTERED NURSES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it is a matter of statewide concern to support the continued training of advanced practice registered nurses to address the State's critical shortage of primary care providers.  The legislature further finds that an advanced practice registered nurse residency program will assist advanced practice registered nurses in the transition to professional clinical care settings and address the experience gap that is occurring in the nursing profession since more primary care providers are needed due to the Affordable Care Act.  Advanced practice registered nurses who complete a residency program will be highly qualified and competent to fill the needed health care provider roles and deliver high quality patient care.

     The purpose of this Act is to establish an advanced practice registered nurse residency program at the University of Hawaii center for nursing to transition newly graduated advanced practice registered nurses to a clinical workplace.

     SECTION 2.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to subpart E of part IV to be appropriately designated and to read as follows:

     "§304A-    Advanced practice registered nurse residency program; establishment; center for nursing.  (a)  There is established, within the University of Hawaii center for nursing, an advanced practice registered nurse residency program.  The program shall be a six to nine-month training program that provides new advanced practice registered nurse graduates with clinical practice under the tutelage of an advanced practice registered nurse within the different specialties to improve patient care and satisfaction.

     (b)  The dean of the University of Hawaii school of nursing and dental hygiene shall be responsible for:

     (1)  Developing and implementing the residency program in cooperation with the nursing profession, medical residency programs, hospitals, and clinics located throughout the State;

     (2)  Using the Fellowship and Residency Electronic Interactive Database Access System or developing an alternate selection process and procedures to select resident advanced practice registered nurses; provided that eligible participants shall:

          (A)  Be graduates of an accredited graduate nursing program that is recognized by the Accreditation Commission for Education in Nursing or the Commission on Collegiate Nursing Education;

          (B)  Hold a current unencumbered license under chapter 457, as an advanced practice registered nurse in this State; and

          (C)  Have less than twelve months of experience working in their field of licensure,

          provided that a person who is in the final semester or

          has recently completed an eligible advanced practice

          registered nurse program may apply for the advanced

          practice registered nurse residency program if the

          person obtains licensure prior to participating in the

          program;

     (3)  Determining where residency education and training shall be established, giving priority consideration to communities in the State where the population, hospital facilities, number of advanced practice registered nurses, and interest in the nursing profession are conducive to success of residency education and training and will benefit the provision of health care in the State; and

     (4)  Adopting rules pursuant to chapter 91 to effectuate the purpose of this section, including determining fines and penalties for violations of subsection (d).

     (c)  Any stipends for the advanced practiced registered nurses in the advanced practice registered nurse residency program shall be paid from the general medical education fund.

     (d)  Upon completion of the advanced practice registered nurse residency program, an advanced practice registered nurse shall be required to commit to two years of full time employment at the facility where the residency occurred in the State.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 to carry out the purposes of this Act.  The sums appropriated shall be allocated as follows:

     (1)  $         for fiscal year 2017-2018; and

          $         for fiscal year 2018-2019,

for one permanent, full-time equivalent (1.0 FTE) program coordinator position; and

     (2)  $         for fiscal year 2017-2018; and

          $         for fiscal year 2018-2019,

for one permanent, full-time equivalent (1.0 FTE) clinical placement coordinator position,

within the University of Hawaii center for nursing to coordinate the residency opportunities and residency positions available between the center for nursing and the participating hospitals and other health care facilities.

     The sums appropriated shall be expended by the University of Hawaii for purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2017.
