RELATING TO EDUCATION.

Exempts a licensed or credentialed practitioner practicing within the practitioner's own recognized scope of practice from licensure and certification requirements.  Temporarily exempts from the licensing requirements for the practice of behavior analysis, direct support workers who provide autism treatment services pursuant to an Individualized Education Plan. Requires the Department of Education to report to the Legislature on implementing measures to comply with the licensure and certification requirements.  (SB1311 HD1)

RELATING TO SEARCH WARRANTS.

Allows courts to authorize a person or entity, other than an officer of justice, to carry out a search warrant.  Allows courts to authorize an officer to obtain technical assistance if the search warrant granted pertains to an electronic device or storage media and the officer submits a sworn statement.  (SB2103 HD1)

RELATING TO THE COLLECTION OF RESTITUTION FOR CRIME VICTIMS.

Creates standards and procedures for income-withholding for purposes of enforcing restitution orders.  Amends the definition of "debt" relating to the recovery of money owed to the State to include court-ordered restitution subject to civil enforcement.  Provides priority of income withholding orders.  Extends victims' access to adult probation records to include access to payment compliance records.  Requires that any bail posted by a defendant be applied toward payment of any court-ordered restitution in the same case.  Makes permanent Act 119, SLH 2011, which allows certain adult probation records to be provided to certain case management, assessment, or treatment service providers upon the screening for admission, acceptance, or admittance of the defendant into a treatment program.  Extends for an additional two years the increase in percentage deducted from inmates' earnings for restitution payments pursuant to Act 139, SLH 2012.  Appropriates funds.  (SB2104 HD1)

RELATING TO AGRICULTURE.

Appropriates funds for operation, repair, maintenance, and improvement costs for the East Kauai Irrigation System by the East Kauai Water Users' Cooperative.  (SB2217 HD1)

RELATING TO PRIVATE ROADS.

Establishes a temporary roads commission to make recommendations on the disposition of private roads and roads in limbo.  Authorizes the State or a county to obtain ownership over a road by condemnation pursuant to the power of eminent domain.  Exempts a county from having to modify a road to meet current construction standards if the road was built according to standards in place at the time of construction and completion.  Allows for private road owners to petition the mayor to begin condemnation proceedings if certain requirements are met.  Exempts the State and counties from maintaining or improving condemned roads.  Appropriates funds for the repair and improvement of certain roads.  (SB2372 HD1)

RELATING TO AQUATIC RESOURCES PENALTIES.

Authorizes the court to require a person who violates certain laws pertaining to aquatic resources to:  (1) complete an aquatic resources educational class administered by the Department of Land and Natural Resources (DLNR) in addition to or in lieu of paying a monetary fine; and (2) perform community service administered by DLNR in lieu of paying a monetary fine.  (SB2453 HD1)

RELATING TO CONCUSSIONS.

Expands the concussion educational program established under Act 197, Session Laws of Hawaii 2012, and incorporates additional concussion protocol program requirements.  Appropriates funds to develop and implement the concussion monitoring and education program for school athletics and youth athletic activities, administer concussion testing to high school student athletes, and implement a concussion awareness program for Hawaii public school students aged 11 to 13. RELATING TO WATER AUDITS.

Establishes a working group to evaluate the issue of balance billing in the State.  (SB2668 HD2)

RELATING TO A LAW ENFORCEMENT EMPLOYMENT STANDARDS AND TRAINING BOARD.

Establishes a temporary advisory law enforcement employment standards and training board with the responsibility of developing statewide employment standards and training recommendations for law enforcement officers who carry firearms and wear a badge.  Allows the relevant government agencies to voluntarily implement the employment standards and training recommendations.  (SB2755 HD1)

RELATING TO THE MOLOKAI IRRIGATION SYSTEM WATER USERS ADVISORY BOARD.

Amends eligibility requirements for membership on the Molokai Irrigation System Water Users Advisory Board.  Makes agents, officers, and employees of system users eligible and removes requirement that members be an active general excise tax licensee.  (SB2788 HD1)

RELATING TO ESCROW DEPOSITORIES.

Clarifies the escrow depositories law by:  adding definitions; authorizing the commissioner of financial institutions to use NMLS for its escrow depositories program; adding criminal history record check and disclosure requirements to licensure and change in control applications; updating the escrow depository license renewal date for consistency with NMLS; clarifying sale or transfer of license or change in control requirements; and updating certain fees.  (SB2849 HD1)

RELATING TO AGE OF CONSENT FOR ADOLESCENT MENTAL HEALTH SERVICES.

Reduces barriers to accessing mental health services for minors by lowering the age of consent to receive treatment and services, other than prescription medication or out-of-home or residential treatment from eighteen years of age to fourteen years.  (SB2886 HD2)

RELATING TO FORENSIC MENTAL HEALTH PROCEDURES.

Ensures the timely administration of mental health examinations.  Separates examination for fitness to proceed from examinations to determine capacity for penal responsibility.  Clarifies the procedure after a finding of unfit to proceed to reevaluate and restore fitness to proceed. RELATING TO THE STATE ETHICS COMMISSION.

Reduces the appropriation in Act 151, Session Laws of Hawaii 2015, to the State Ethics Commission for an electronic filing system and reappropriates savings to fund a lobbyist law task force.  Establishes a task force to examine the State's lobbyist laws and to make recommendations to the Legislature.  (SB3024 HD2)
