RELATING TO PROPERTY.

Amends the thresholds for the exemption of real property from attachment or execution to be based upon the most recent real property tax assessment, regardless of value and for all types of property owners.  Clarifies that attachment or execution does not apply to a debtor who is not delinquent in payment of income taxes, real property taxes, or mortgages.  Bases the value threshold of certain personal property exempted from attachment and execution on the fair market value as adjusted by the consumer price index.  Exempts child support moneys and tax refunds from the federal earned income tax credit and federal or state child support tax credit from attachment and execution.

RELATING TO PLANNED COMMUNITY ASSOCIATIONS.

Authorizes the members of a planned community association to call a special meeting by petition signed by not less than 25% of the members.

RELATING TO THE BOARD OF EDUCATION.

Requires that at least one member of the board of education have a minimum of 5 years of classroom teaching experience within the public educational system.

RELATING TO THE CYTOMEGALOVIRUS.

Requires DOH to establish a public education program on the cytomegalovirus to educate pregnant women and women who may become pregnant.  Requires the responsible physician of a newborn infant identified as, or suspected of, having a hearing impairment to test the newborn infant for the cytomegalovirus.

RELATING TO HEALTH.

Expands the list of state-licensed care facilities for which the Department of Health is required to post electronic inspection reports on its website.  Requires the Department to maintain a forum on its website where state-licensed care facilities may post vacancy information.

RELATING TO THE SECURE AND FAIR ENFORCEMENT FOR MORTGAGE LICENSING ACT.

Establishes a mortgage license exemption for sellers of real property who offer or negotiate terms of a mortgage loan secured by the seller's own real property; provided that the seller does not engage in more than three mortgage loans in one calendar year.

RELATING TO THE REGULATION OF TOBACCO PRODUCTS.

Amends chapter 328J, Hawaii Revised Statutes, to prohibit the use of electronic smoking devices in the places where smoking is prohibited and updates signage requirements.

RELATING TO HEALTH.

Extends the date by which the Department of Health must post inspection reports for state-licensed care facilities by six months and increases the number of days to post the reports, as recommended by a legislative task force.

RELATING TO THE BOARD OF EDUCATION.

Extends voting rights to a student member of the Board of Education.

RELATING TO MARIJUANA.

Authorizes the counties to adopt ordinances to legalize marijuana possession, sale, and use, for persons over the age of twenty-one.  Clarifies that penal code provisions pertaining to drug and intoxicating compounds offenses do not apply to counties that have adopted ordinances legalizing marijuana and adopted administrative rules to regulate marijuana.

Appropriates funds to identify, plan, and acquire or build upon real property in urban Honolulu to provide office space for state governmental agencies and offices

Transfers title to certain parcels of land from the University of Hawaii to the Hawaii Housing Finance and Development Corporation for development of affordable housing and income generation for University of Hawaii-West Oahu.

RELATING TO HAWAIIAN AFFAIRS.

Prohibits the transfer of inmates in the custody of the department of public safety to any correctional facility that is not operated by and within the State.  Removes mandatory minimum sentencing for methamphetamine drug offenses.

RELATING TO THE STATE FUEL TAX.

Changes the assessment of the state fuel tax from a specified cents per gallon to the greater of a specified cents per gallon or a specified percentage of the wholesale price per gallon to the retailer, subject to a minimum monetary amount of tax based upon the tax paid by certain retailers.
