Requires persons who engage in lobbying ninety days prior to the convening of a special session or through sine die of that special session, or both, to file a statement of expenditures with the state ethics commission within ten days of sine die of that special session. Amends the definition of "lobbyist" to include persons who lobby in excess of five hours in any month during the ninety days prior to the convening of a special session or through sine die of that special session, or both, or who spend more than $750 lobbying during that same period.

RELATING TO DISPOSABLE CONTAINERS. Requires restaurants or food establishments to provide consumers with the option of using compostable or reusable disposable food service containers. Requires signs to be posted informing consumers that such containers are available. Establishes penalties for violations. Effective July 1, 2014.

RELATING TO SOLAR ENERGY. Allows solar energy facilities to be placed within agricultural lands with soil classified as overall productivity rating class B or C if the area occupied by the solar energy facilities is also devoted to agricultural activities and requires that the solar energy facilities be decommissioned and removed within twelve months of the conclusion of operation.

RELATING TO STORMWATER MANAGEMENT. Authorizes any county to establish and charge user fees to maintain stormwater management systems and infrastructure. Directs the Commission on Water Resource Management to report to the legislature on reducing stormwater runoff quantity and incentivizing stormwater reclamation and reuse.

Requires motor vehicle safety inspection stations to inspect motor scooter exhaust pipes or mufflers and motor vehicle mufflers to ensure that the noise emitted meets certain requirements. Provides penalties for inspection stations that issue safety inspection certificates in violation of muffler and exhaust requirements.

Amends provisions of chapter 806D, Hawaii Revised Statutes, which allow for the service of process issued by another state upon a Hawaii recipient, and clarifies the following: (1) that the service of process may be upon a person or business, but not a government agency; (2) that the process is for the production of records; (3) that the process must be based upon a pending criminal investigation or prosecution; and (4) that the person or business being served must have conducted business or engaged in transactions or activities occurring at least in part in the issuing state. Requires the process to include specified information. For valid process, requires that the issuing state have a law authorizing the production of records by out-of-state persons or businesses and a reciprocity provision. Also amends the definition of "recipient," to clarify that the recipient, who receives process issued in Hawaii, must have conducted business or engaged in transactions or activities occurring at least in part in Hawaii.

RELATING TO THE PROTECTION OF CHARITABLE ASSETS. Enacts section 3 of the Model Protection of Charitable Assets Act that provides that the Attorney General has charitable oversight over charitable assets regardless of the form in which they are held; authorizes the Attorney General to enforce the application of the charitable asset and prevent or remedy breaches of fiduciary or other duty or the diversion or waste of a charitable assets.

RELATING TO MEDICAL ASSISTANCE FRAUD. Amends section 346-43.5, Hawaii Revised Statutes, to clarify that fraudulently applying for or renewing medical assistance benefits is a class C felony, and to clarify the amount of restitution when the fraud is committed by a recipient of medical assistance benefits. Amends the statute of limitations provision under section 701-108, Hawaii Revised Statutes, to include the offense of medical assistance fraud with other felony offenses involving fraud or deception.

Expands the application of mandatory mortgage foreclosure dispute resolution by requiring mortgagees, including Hawaiian home lands trust homestead beneficiaries and lawful successors in interest, to participate, at the mortgagor's election, in mediation to avoid foreclosure or mitigate damages from foreclosure prior to filing a judicial foreclosure action for property that has been the mortgagor's primary residence for a specified period. Applies the dispute resolution requirement to judicial foreclosure actions filed prior to the effective date of this bill and pending an initial court hearing. Effective upon approval.
