Allows qualified entities to conduct state and national fingerprint-based criminal history record checks on their applicants, employees, and volunteers who provide care for children, vulnerable adults, or the disabled, and to receive the results directly.

RELATING TO THE RETENTION OF BIOLOGICAL EVIDENCE.

Establishes specific offenses for which evidence shall be retained.  Allows law enforcement agencies to petition the court to dispose of biological evidence.  Requires the court to use a preponderance of evidence standard in determining whether to allow the law enforcement agency to dispose of the biological evidence.

Status

RELATING TO UNSWORN FALSIFICATION TO A LAW ENFORCEMENT OFFICER.

Establishes the offense of Unsworn Falsification to a Law Enforcement Officer prohibiting a person from intentionally or knowingly making a false statement, or making or using a false document, to an officer during the course of an investigation that is materially false, fictitious, or fraudulent.

Status

RELATING TO THE STATEWIDE INTEGRATED SEX OFFENDER TREATMENT PROGRAM.

Amends Chapter 353E, Hawaii Revised Statutes (HRS), to include juveniles, to reflect nationally recognized best practices in the statewide, integrated programming for sex offenders, and to identify the coordinating body for the sex offender treatment program as the "Sex Offender Management Team."  Exempts the Program from the requirements of Chapter 92, HRS.

Status

RELATING TO PUBLIC SAFETY.

Provides systematic diversion and reentry programming for low-risk drug offenders by establishing the Diversion and Reentry Pilot Project for Low-risk Drug Offenders.  Effective July 1, 2014, and repealed on June 30, 2016.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to two minutes.  This two minute policy will be enforced to ensure fairness and adequate consideration to all bills.
