RELATING TO VIOLENCE AGAINST HEALTH CARE PERSONNEL. Adds intentionally or knowingly causing bodily injury to medical services providers to assault in the second degree offense. Expands the medical services providers to which the offense would apply. Effective 07/01/50. (SD2)

RELATING TO CAREGIVING. Permits hospitals to allow patients the opportunity to designate a lay caregiver. Allows hospitals to include the designated lay caregiver in the patient's medical record, notify the lay caregiver prior to the patient's transfer or discharge, consult with the lay caregiver about the patient's discharge plan, and instruct the designated lay caregivers in after-care. Provides immunity to hospitals and their employees that allow patients the opportunity to designate a lay caregiver or provide voluntary after-care training. Effective 7/1/2050. (SD2)

RELATING TO TOBACCO PRODUCTS. Imposes an excise tax equal to an unspecified percentage of the wholesale price of any tobacco product, other than large cigars, sold by a wholesaler or dealer on and after 1/1/2015, whether or not sold at wholesale, or if not sold then at the same rate upon the use by the wholesaler or dealer. Requires any increase in the excise tax rate imposed on cigarettes or little cigars on or after 1/1/2015 to trigger an automatic excise tax increase on other tobacco products on or after 1/1/2015. Requires the moneys collected under the excise tax on tobacco products to be deposited to the credit of the Hawaii cancer research special fund. Effective 1/1/2050. (SD2)

Requires birthing facilities to perform a pulse oximetry test to screen for critical congenital heart defects, as well as other procedures as specified by the guidelines of the American Academy of Pediatrics, on every newborn in its care prior to discharge from the facility, with certain exceptions.
