RELATING TO INFANT MORTALITY.

Establishes a Comprehensive Maternal and Child Health Quality Improvement Program and Hawaii Maternal and Child Health Quality Improvement Collaborative within the Department of Health.  Requires the Department of Health to develop and publish a strategic plan on maternal and child health quality improvement.  Effective July 1, 2014.

MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF HEALTH FOR THE DEVELOPMENTAL DISABILITIES DIVISION.

Authorizes an emergency appropriation for FY 2013-2014 $500,000 from general funds to the Department of Health, for ongoing services provided by the developmental disabilities division.

RELATING TO PRIVACY OF HEALTH CARE INFORMATION.

Amends the statutes to protect the privacy of developmental disability and mental health patients' health information, while allowing reasonable use and disclosure as provided by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Establishes a bill of rights for disabled persons.

Status

RELATING TO BEHAVIORAL SUPPORT REVIEW OF RESTRAINTS AND SECLUSION.

Establishes authority for a behavioral support review process to assess the use of restraints and seclusion for individuals with developmental or intellectual disabilities, and allow participants exemption from liability for the use and review of information and records and activities pertaining to behavioral support reviews of persons with developmental or intellectual disabilities.

Status

RELATING TO THE REGULATION OF ELECTRONIC SMOKING DEVICES.

Amends chapter 328J, Hawaii Revised Statutes, to prohibit the use of electronic smoking devices in the places where smoking is prohibited and updates signage requirements.

Status

RELATING TO THE USE OF TOBACCO AND E-CIGARETTES ON HAWAII HEALTH SYSTEMS CORPORATION PREMISES.

Amends chapter 323F, Hawaii Revised Statutes, to prohibit the use of tobacco products and e-cigarettes at Hawaii Health Systems Corporation health facilities.

Status

RELATING TO ADMINISTRATIVE PENALTIES.

Increases from $100 per day to a maximum of $10,000 per day fines levied for violations of sanitation laws and rules for establishments required to undergo sanitation inspections by the Department of Health.  The increase in sanitation penalties establishes parity with existing food adulteration penalties.

RELATING TO THE NEUROTRAUMA ADVISORY BOARD.

Revises the total number of Neurotrauma Advisory Board from 21 to 11 members while still maintaining representation of all existing parties.

RELATING TO HEALTH CARE PRIVACY.

Specifies conditions under which individual health care information can be used or disclosed.  Provides penalties.  Effective July 1, 2014.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number.

FAX:       For testimony less than 5 pages in length, transmit to 808-586-6281 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or

WEB:      For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

                Electronic testimony will be accepted until the start of the hearing.

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
