RELATING TO CABLE TELEVISION SYSTEMS. Requires the director of commerce and consumer affairs to order cable franchise applicants to provide equipment and maintenance sufficient to ensure that cable subscribers in the franchise area are able to receive public, educational, and governmental access channels equivalent in quality to local full-power broadcast signals carried on the cable system.

RELATING TO CABLE TELEVISION SYSTEMS. Removes the sunset provision in Act 19, Session Laws of Hawaii 2011, thereby permanently allowing the director of commerce and consumer affairs to designate an access organization to oversee public, educational, and governmental channels

RELATING TO CYBERSECURITY. Establishes the Hawaii cybersecurity, economic, education, and infrastructure security council to develop methods to improve the State's cybersecurity.

RELATING TO THE INVESTOR EDUCATION PROGRAM. Appropriates funds for the continued operation of the investor education program, targeted to kupuna, within the department of commerce and consumer affairs office of the securities commissioner.

RELATING TO FISH LABELING. Establishes a violation and penalties for the misbranding of fish or fish products that result in consumer illness. Creates the fish misbranding special fund.

RELATING TO INSURANCE CONTRACTS. Makes clarifying amendments to the laws on general rules governing insurance contracts with respect to excepted lines of insurance and the conditions under which attorney's fees and costs of suit may be awarded.

RELATING TO UNLICENSED CONTRACTOR FRAUD. Clarifies the offense of unlicensed contractor fraud by specifying that the "intent to deprive" may be formed before or after the person obtains or exerts control over the property of another.

RELATING TO PRESCRIPTION DRUGS. Mandates insurance commissioner to assess a fine of up to $10,000 for each violation by a pharmacy benefit manager or prescription drug benefit plan provider.

RELATING TO PROCUREMENT. Prohibits governmental procurement contracts of any amount that are exclusively for the services of contractors, engineers, architects, surveyors, or landscape architects, from requiring the person to defend the governmental body against liability not arising from the contractor's own negligence or fault. Provides that the contractor may still be required to indemnify and hold harmless the governmental body from claims arising out of or resulting from the negligent, reckless, or wrongful acts, errors, or omissions of the contractor.

RELATING TO SEAWATER AIR CONDITIONING. Enables the production of air conditioning in an area or district from a seawater air conditioning cooling system to benefit as an "eligible business activity" under the State's enterprise zones program.

RELATING TO SPECIAL PURPOSE REVENUE BONDS TO ASSIST SEAWATER AIR CONDITIONING PROJECTS ON OAHU. Extends the authorization of the issuance of special purpose revenue bonds to Honolulu Seawater Air Conditioning, LLC, for the purpose of design and construction of a seawater air conditioning district cooling system in downtown Honolulu, for an additional five years. Effective June 30, 2014.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony no later 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;

· The date and time of the hearing; and

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing. Those wishing to provide oral testimony will be limited to two minutes.

Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
