Allows beneficiaries of prescription drug benefits providers to opt out of the requirement to purchase prescription drugs from a mail-order pharmacy and may alternatively purchase prescription drugs from a retail pharmacy.

RELATING TO HIGHER EDUCATION.

RELATING TO HOMELESS PROGRAMS.

Requires the designation of temporary nighttime parking lots in each county to provide locations where homeless individuals who live and sleep in their vehicles can park overnight.

RELATING TO TAXATION.

Requires payors of non-wage payments for construction services to report the payments to the department of taxation and the provider of construction services.

RELATING TO LEAVE.

Authorizes family school leave for employees of employers who employ an unspecified number of employees, provided certain requirements are met, so that employees may participate in their children's school activities.  Prohibits employers from discharging or otherwise discriminating against an employee for taking family school leave.  Allows for a civil penalty in an amount equal to three times the amount of the employee's lost wages and benefits in certain circumstances.

RELATING TO HARBORS.

Authorizes the Department of Transportation to adopt rules to impose upon private parties who use state commercial harbors the duty to defend, indemnify, and hold harmless the State against claims that arise from such use.

Adds to the definition of agricultural commodities exempt from the GET, milk, poultry eggs, poultry carcass, poultry meat, and aquaculture and aquaponic products to be consumed in the State, whether processed in the State or imported.

RELATING TO ADEQUATE HIGHWAY REQUIREMENTS.

Requires the director of transportation to certify to the governor that adequate highway capacity exists in a county's business district at a minimum of level of service D before any construction of a new subdivision or housing development project can commence in the county.

RELATING TO ELECTRICITY RATES.

Establishes a pilot program to determine whether preferential electricity rates for agricultural activities will better aid in the sustainable perpetuation of local agriculture in Hawaii.
