A BILL FOR AN ACT

relating to smoking.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§328J-   Smoking prohibition; bus stops, beaches, parks, vehicles. (a)  Smoking shall be prohibited as follows:

(1) At public bus stops; provided that the prohibition shall extend to a distance of       feet surrounding the bus stop;

(2) On beaches;

(3) At public parks; and

(4) In any vehicle where a minor is present in the vehicle.

(b)  As used in this section:

"Minor" means any person under the age of eighteen.

"Public bus stops" means stops along bus routes to pick up and drop off riders of a bus that is operated by a county for public transportation.

"Public parks" means any park, park roadway, playground, athletic field, or beach right-of-way that is under the control, maintenance, and management of the State or a county.

"Vehicle" means any mode of transport, public or private, operated for any purpose."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
