Amends the title of Act 210, Session Laws of Hawaii 2008, to read news and broadcast media privilege.  Expands the application of the Act to expressly include bona fide owners or editors of news or broadcast media entities.  Clarifies that, where applicable, the news and broadcast media privilege will shield a journalist, newscaster, owner, or editor of a news or broadcast media entity from being compelled to testify or produce the source of information whether or not it has been published or broadcasted, or any unpublished or unbroadcasted information.

RELATING TO THE MOTOR VEHICLE RENTAL INDUSTRY.

Provides that lessors may pass on vehicle title, plate, registration, and inspection costs to lessees.

RELATING TO FORECLOSURES.

Repeals the provision automatically making all violations of the mortgage foreclosure law an unfair or deceptive act or practice, in favor of determinations made on a case-by-case basis.  Establishes a time limit for filing actions to void title transfers of foreclosed property.  Specifies a mortgagor's right to claim that a violation of the mortgage foreclosure law constitutes an unfair or deceptive act or practice.  Provides that a mortgagee's failure to demonstrate rights of a holder in due course is prima facie evidence of an unfair or deceptive act or practice.  Following the expiration of the mortgage foreclosure dispute resolution program in 2014, specifies certain foreclosure violations as unfair or deceptive acts or practices, and limits the types of violations that may void a title transfer of foreclosed property.

Adds new definitions to computer crime, including identifying information, malware, phishing, and spyware.  Establishes a third degree of computer fraud, and incorporates the element of phishing into all three computer fraud offenses.  Amends the offense of unauthorized computer access in the third degree to include distributing or transferring spyware without authorization or by deceptive means.

Establishes a legal mechanism by which an employer or employee may seek a temporary restraining order, or preliminary or permanent injunctive relief on their own behalf or on the behalf of others, to prohibit workplace violence or the threat of workplace violence.

Prohibits exclusivity or curtailment provisions in power purchase agreements between an electric utility and producers of electricity generated from geothermal steam or nonfossil fuel sources.

RELATING TO TAXATION.

Repeals Act 155, SLH 2010, which:  (1) requires all businesses with excise tax exemptions to register to do business in Hawaii, file their tax returns in a timely manner, and expressly claim their entitlement; and (2) creates a personal trust liability for businesses that use the general excise tax as the basis for increasing their prices and ensures that those funds are paid to the State for the benefit of consumers and businesses.

Clarifies that funding for the adult and community education program shall be from appropriations by the legislature, supplemented by student fees.  Establishes the adult and community education program special fund.

By January 1, 2014, requires businesses to implement a comprehensive, written policy and procedure to prevent identity theft, and to designate an employee to be responsible for protecting personal information.  Requires businesses to train all employees in the implementation of the policy and procedure.

Requires the DOE to develop procedures for reasonable suspicion and random substance abuse testing of, at a minimum, 10% of all public school teachers and teacher trainees each year.  Requires the DOE to adopt rules to determine sanctions for positive substance abuse assessments.  Makes an appropriation to DOE.

Conforms public housing eviction procedure to requirements of federal law.  Requires evictions to be conducted by an eviction board appointed by the Hawaii public housing authority in collaboration with DHS.

Requires the family court to maintain a computerized database containing information regarding covered offenders who have at least three convictions of abuse of a family or household member.  Specifies information the database must contain.  Allows a covered offender whose name is included in the database to petition for removal of the covered offender's name under certain circumstances.

Prohibits law enforcement from seizing motor vehicles for forfeiture if the vehicle is primarily used by the owner for personal use and there has been no conviction for the underlying offense.
