Amends the offense of violation of privacy in the second degree under section 711-1111, HRS, to exclude surveillance of another person in a stage of undress or sexual activity because that conduct is prohibited by the offense of privacy in the first degree under section 711-1110.9, HRS.

Amends sections 708-895.5, 708-895.6, and 708-895.7, to increase unauthorized computer access in the first degree to a class A felony, increase unauthorized computer access in the second degree to a class B felony, and increase unauthorized computer access in the third degree to a class C felony; where unauthorized computer access in the first degree is charged based on the monetary value of information obtained, raises the minimum monetary value to $20,000.

Adds new definitions to computer crime, including cookie, identifying information, phishing, and spyware.  Makes it a criminal offense to distribute or transfer spyware that, amongst other things, modifies an authorized user's access to or use of the Internet, or collects the internet addresses visited by an authorized user.  Creates a third degree of computer fraud, and incorporates the element of phishing into all three computer fraud offenses.

Requires drivers' license revocations upon convictions for negligent homicide in either the first or second degree.  Sets maximum periods of license revocations for convictions of manslaughter and negligent homicide in the first or second degree.  Makes imprisonment of up to two years a discretionary condition of probation for manslaughter convictions.  Clarifies that probation is an available sentence for manslaughter.

Limits the health insurance benefits for an employee who is first hired after 06/30/12 and who retires with at least 10 years of credited service.  Provides that, if the employee retires before reaching the medicare-eligible age, the retired employee shall be allowed to enroll only in a non-medicare self plan.  Requires the State or county to make a contribution towards the non-medicare self plan cost.  Requires the retired employee to enroll in the medicare part B medical insurance plan if the employee retires upon or after reaching the medicare-eligible age.  Requires contributions to or reimbursements for the medicare part B premium.  Prohibits the retired employee from enrolling in any health benefits plan of the fund.  Provides also that the spouse of a retired employee who is first hired after 06/30/12 shall not be eligible for medicare part B premium reimbursements.

Requires lessors of commercial and industrial property to afford lessees the option of renewing their leases.  Requires, in leasehold renegotiations, that a rent based on fair market value shall apply even if that value is lower than existing rent and the lease contract bars the lowering of rent upon renegotiation.
