RELATING TO TRESPASS.

Makes entering or remaining unlawfully on unimproved or unused agricultural lands without permission an offense of criminal trespass in the second degree if the lands are fenced, enclosed, or secured, or a sign is displayed.  Includes entering or remaining on agricultural lands that are fallow or have evidence of livestock at the time of entry in the offense of trespass in the second degree.  Establishes limited liability of agricultural land owners for any injury, death, loss, or damage suffered by a trespasser.  Adds definitions of "agricultural land", "fallow", "owner", "trespasser", and "unimproved or unused lands".  (SD2)

RELATING TO TOBACCO PRODUCTS.

Imposes an excise tax on tobacco products other than cigarettes, little cigars, and large cigars.  Imposes an excise tax on bulk and small quantity purchases of tobacco products and cigars.  Requires a portion of the tax to be expended for tobacco prevention programs and services.  Effective 7/1/2050.  (SD1)

RELATING TO FOOD SAFETY.

Creates the food safety and security program within the department of agriculture.  Requires the department of agriculture to adopt rules regarding the production, processing, and distribution of food products or agricultural commodities to meet state and federal food safety standards.  Effective 7/1/2050.  (SD2)

RELATING TO KAKAAKO.

Establishes the Kakaako makai community development subdistrict.  Requires the HCDA to act as the local development authority to facilitate the development of the Kakaako makai community development subdistrict in accordance with the Kakaako makai area plan and the cultural public market.  Adds three members to the HCDA board to represent the Kakaako makai community development subdistrict.  Replaces one county member who represents small businesses on the HCDA board with the director of planning and permitting of the city and county of Honolulu.  Provides the HCDA with subdivision powers over lands and real property within the Kakaako community development district.  Repeals the requirement that the HCDA consider recommendations by the Kakaako makai community planning advisory council in developing, accepting, and implementing any plans for the Kakaako makai area.  (SD2)

RELATING TO LIQUOR LIABILITY INSURANCE.

RELATING TO PUBLIC EMPLOYMENT.

Limits the Employer-Union Health Benefits Trust Fund to providing group life insurance benefits only to retired employees who retired before July 1, 2011.  Maintains the flat dollar contribution for the group life benefit of retired employees and repeals the annual adjustment.  Repeals provisions pertaining to the negotiation of group life insurance contributions for active employees.  Effective July 1, 2050.  (SD1)

RELATING TO FUNDING FOR PARKING FOR DISABLED PERSONS.

Creates an accessible parking special account within the disability and communication access board special fund.  Increases the state vehicle registration fee by $1, to be deposited into the accessible parking special account; excess funds to be transferred to the state highway fund at the end of each fiscal year.  Requires all costs associated with the statewide parking program for persons with disabilities to be appropriated from the accessible parking special account beginning July 1, 2012.  (SD1)

RELATING TO MENTAL HEALTH RELEASE ON CONDITIONS OF A PERSON FOUND UNFIT TO STAND TRIAL.

Requires the Department of Health to provide a fitness restoration program for defendants unfit to proceed with court proceedings and on conditional release, and to report information regarding defendant's program and compliance to the prosecutor of the county where the defendant was charged.  (SD1)

RELATING TO CONTROLLED SUBSTANCES.

Amends chapter 329, Hawaii Revised Statutes, to conform Hawaii law on controlled substances with federal laws on controlled substances, and increases the fee for the registration certificate for qualifying patients for medical marijuana.  Effective 7/1/2050.  (SD2)

RELATING TO INTOXICATING LIQUOR.

Exempts a liquor licensee from liability for certain violations if the licensee has in place a security plan approved by the liquor commission to prevent consumption of liquor by a minor and the licensee acts in good faith to implement the plan.  Effective July 1, 2050.  (SD2)

RELATING TO DIGITAL MEDIA.

Amends the motion picture, digital media, and film production tax credits to increase the tax credits to unspecified percentages and dollar amounts and to provide additional non-refundable tax credits for qualified media infrastructure projects in certain qualifying counties; provides an additional tax credit for qualified special or visual effects and animation production costs; raises the tax credit caps to unspecified amounts.  Effective 07/01/2050.  (SD2)

Establishes a nine-member Native Hawaiian roll commission to prepare and maintain a roll of qualified Native Hawaiians; requires the commission, after publication of the roll, to appoint an interim council of nine members from the roll to commence the organization of a convention of qualified Native Hawaiians; requires the governor to dissolve the commission after the interim council is appointed; appropriates unspecified funds.  (SD1)

RELATING TO THE MOLOKAI IRRIGATION SYSTEM.

Requires the department of agriculture to provide water at a reduced rate to Molokai irrigation system users who lease tracts of land under section 207 of the Hawaiian Homes Commission Act, 1920, as amended.  Authorizes the department of agriculture to forgive past due amounts owed by Molokai homestead farmers for irrigation water.  Appropriates funds to cover the operational costs of the Molokai irrigation system.  Effective 7/1/2030.  (SD2)

RELATING TO FUEL TAXES.

Permits the county of Hawaii to appropriate the county's share of fuel tax revenue for the maintenance of substandard private subdivision roads that are used by the public.  Provides that neither the State nor the county shall be required to install infrastructure improvements if the roads are thereafter sold to a private entity.  Sunsets 6/30/16.  Effective 7/1/30.  (SD2)
