A BILL FOR AN ACT

RELATING TO SMOKING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328J-     Beaches. Smoking shall be prohibited on Waikiki beach on the island of Oahu within tax map key parcel numbers 2-6-10:07 and 3-1-31:01 in the shoreline area.  As used in this section, "shoreline area" means the immediately adjacent ocean waters to the seaward boundary of any:

(1) Privately held real property;

(2) Public parking lot; or

(3) Highway as defined in section 291C-1;

provided that smoking shall be permitted on public sidewalks immediately adjacent to a highway unless otherwise prohibited by law, including section 328J-6."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2020.
