Madam:

 

     Your Committee on Judiciary and Labor, to which was referred H.B. No. 2436, H.D. 2, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO FIREWORKS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to strengthen the regulation and enforcement of fireworks by:

 

     (1)  Adding a reference to the most recent citation to federal regulations for purposes of the definition of "display fireworks";

 

     (2)  Clarifying the prohibitions on using fireworks without a permit;

 

     (3)  Requiring a permit for the purchase or use of consumer fireworks or for cultural uses during specified times; and

 

     (4)  Prohibiting the sale of fireworks or articles pyrotechnic by minors.

 

     Your Committee received testimony in support of this measure from the State Fire Council and Kauai Fire Department.

 

     Your Committee finds that it is desirable to require individuals who want to ignite consumer fireworks, including paperless firecrackers or any other type of novelty fireworks or firecrackers at other than statutory permissible times, to obtain a permit from the fire department for a fee of $25.  

 

     The intent of the other provisions of this measure is to enhance the enforcement of fireworks prohibitions and to protect the public safety.

 

     Your Committee has amended this measure by amending the title of section 132D-12, Hawaii Revised Statutes, to conform with the amendments to that section by adding "sale by minors".

 

     As affirmed by the record of votes of the members of your Committee on Judiciary and Labor that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2436, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 2436, H.D. 2, S.D. 2.
