SENATE CONCURRENT
RESOLUTION
requesting a sunrise review of the regulation of entities governed by chapter 514B, Hawaii Revised Statutes, and the enforcement of policies relating to condominiums in the State through the creation of a condominium commission.
WHEREAS, the Legislature finds that the number of people living in condominiums in Hawaii has grown tremendously over the years; and
WHEREAS, condominium owners face many important issues and, with the changes in condominium laws over the last few years, the State needs to provide clarity in the current law and must ensure that the current law is being carried out properly; and
WHEREAS, section 26H-6, Hawaii Revised Statutes, requires that "[n]ew regulatory measures being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing or other regulatory controls shall be referred to the auditor for analysis."; and
WHEREAS, section 1 of S.B. No. 1837, introduced during the 2007 Regular Session, proposed the creation of a condominium commission to:
(1) Oversee the implementation and regulation of chapter 514B, Hawaii Revised Statutes, relating to condominiums; and
(2) Develop, implement, and enforce policies relating to condominiums in the State; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the House of Representatives concurring, that the Auditor is requested to perform a sunrise review of the regulation of entities governed by chapter 514B, Hawaii Revised Statutes, and the enforcement of policies relating to condominiums in the State through the creation of a condominium commission, as proposed in section 1 of S.B. No. 1837; and
BE IT FURTHER RESOLVED that the Auditor is requested to report findings and recommendations, including alternate regulatory and enforcement frameworks to the one contained in section 1 of S.B. No. 1837, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2008; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
