HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO PERFORM A STUDY TO DETERMINE WHETHER locksmiths SHOULD BE LICENSED BY THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS.

 

 

 


     WHEREAS, governments, businesses, and individuals often find it necessary to obtain the services of locksmiths; and

 

     WHEREAS, locksmiths are, in many cases, vital to the safety and protection of business, governmental, and home properties; and

 

     WHEREAS, due to the necessary role played by locksmiths, it is important to ensure that these individuals measure up to certain standards of knowledge and experience; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, requires that measures that, if enacted, would subject unregulated professions and occupations to licensing or other regulatory controls be referred to the Auditor for analysis; and

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Auditor is requested to perform a study to determine whether locksmiths should be licensed by the Department of Commerce and Consumer Affairs; and

 

     BE IT FURTHER RESOLVED that this study report on the impact licensure would have on the affected sectors of the State, including businesses, the government, and private homeowners; and

 

     BE IT FURTHER RESOLVED that if the Auditor recommends licensure, the study address at a minimum:

 

     (1)  The need for an applicant to take an examination before obtaining licensure;

 

     (2)  Preliminary qualifications of applicants for admission to examinations, including:

 

          (A)  Educational requirements;

 

          (B)  Post-graduate experience, such as fieldwork or desk work;

 

          (C)  Membership in or certification by any certifying organization; and

 

          (D)  Demonstration of an understanding of the locksmith industry;

 

     (3)  Licensure categories to distinguish between individuals with expertise in different areas of the locksmith industry; and

 

     (4)  License renewal; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report on its findings and recommendations, including proposed legislation, not later than twenty days prior to the convening of the Regular Session of 2008; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and Director of Commerce and Consumer Affairs.
