A BILL FOR AN ACT

 

RELATING TO PROCUREMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to grant the Hawaii health systems corporation a limited exemption to allow for patient care that is consistent with best care practices, and to establish a procurement officer position for the corporation.

SECTION 2. Chapter 323F, Hawaii Revised Statutes, is amended by adding a two new sections to be appropriately designated and to read as follows:

"§323F-   Limited procurement exemption. (a) The corporation shall be exempt from chapter 103D, to the extent that an exemption for a particular procurement of goods or services is necessary to maintain a level of patient care that is consistent with best care practices in the medical profession.

(b) For purposes of this section:

(1) Each procurement shall be considered separately;

(2) The board of directors shall be responsible for approval of every procurement considered exempted; and

(3) Every exempted procurement shall be adequately documented for purposes of audit.

§323F-   Chief procurement officer. Notwithstanding section 103D-203, there shall be a chief procurement officer for the corporation to manage the procurement of the corporation consistent with chapter 103D; provided that the chief procurement officer shall be subordinate to the administrator of the state procurement office under section 103D-204; and provided further that the chief procurement officer shall not hold any other management or executive position within the corporation. The corporation board shall employ and dismiss at its pleasure and fix the compensation of the procurement officer. The procurement officer shall be exempt from chapters 76 and 89."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
