A BILL FOR AN ACT
relating to marine invertebrates.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§188- Commercial taking of certain female marine invertebrates prohibited. (a) Commercial taking, or offering for sale, of female ula (spiny lobster), Kona crab, and Samoan crab is prohibited.
(b) This section shall not be construed to prohibit sale of the female marine invertebrates identified in subsection (a) if they are the product of commercial aquaculture and not taken for sale from their natural environment."
SECTION 2. This Act shall take precedence over any contrary rule adopted by the department of land and natural resources pursuant to chapter 91.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
