Description:
Authorizes the Director of Health to develop and administer rules for a neighborhood watch program, and design and produce signs that inform the public that dumping is illegal, including a list of fines and penalties, and that a neighborhood watch is in effect. Appropriates from the Environmental Response Revolving Fund $100,000 to the Department of Health for the design and production of the signs.

A BILL FOR AN ACT
relating to illegal disposal of solid waste.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342H- Neighborhood watch program. (a) There shall be established within the department a neighborhood watch program.
(b) The neighborhood watch program shall be operated by residents in a community and with the assistance of the department shall develop a program to prevent illegal solid waste disposal that shall include:
(1) Clean up projects;
(2) Community outreach;
(3) Education;
(4) Reporting of illegal solid waste disposal activities;
and
(5) Other appropriate action to prevent illegal solid waste disposal activity.
(c) The department shall develop appropriate signage that shall inform the public that disposal of solid waste anywhere other than a permitted solid waste management system without the written approval of the director is illegal, including a list of fines and penalties that may apply, and that a neighborhood watch program is in effect, to be given without a fee to community groups that have:
(1) Identified and cleaned up chronic illegal dumpsites;
(2) Agreed to put up and maintain signs at chronic illegal dumpsites; or
(3) Maintained a neighborhood watch program.
(d) The department may adopt rules in accordance with chapter 91 for the purposes of this section."
SECTION 2. There is appropriated out of the environmental response revolving fund the sum of $100,000 or so much thereof as may be necessary for fiscal year 2006-2007 for the designing and production of signs informing the public that disposal of solid waste anywhere other than a permitted solid waste management system without the approval of the director of health is illegal, including a list of fines and penalties that may apply, and that a neighborhood watch is in effect in the area.
The sum appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2006.
