A BILL FOR AN ACT

 

relating to theft.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 708-832, Hawaii Revised Statutes, is amended to read as follows:

"§708-832 Theft in the third degree. (1) A person commits the offense of theft in the third degree if the person commits theft:

(a) Of property or services the value of which exceeds $100; [or]

(b) Of gasoline, diesel fuel or other related petroleum products used as propellants of any value not exceeding $200;

(c) Of a person's mail, irrespective of monetary value; or

(d) Possession of another person's mail where the possessor does not reside at the address of the intended recipient of the mail.

(2) Theft in the third degree is a misdemeanor.

(3) For purposes of this section, the theft or possession of an individual's mail shall be treated as one charge of theft in the third degree. If a person commits theft of mail from multiple individuals, the theft of mail from each individual shall represent a charge of theft in the third degree. Theft or possession of mail, under subparagraphs (1)(c) or (1)(d), from three or more individuals in a one year period shall constitute a class C felony. Subsequent violations of subparagraphs (1)(c) and (1)(d) within a ten year period from the conviction of the previous offense shall be a class C felony."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
