RELATING TO AN ADVISORY REFERENDUM ON GAMING IN HAWAII.

Requires an advisory referendum consisting of a question to be placed on the ballot for the general election of 2006 on whether the electorate wishes the State to legalize gaming.

Amends the conditions used to determine whether or not a vehicle is a derelict vehicle by eliminating the age of a vehicle as a condition and including abandonment as a condition.

Makes it illegal for any person to manufacture, sell, display, or possess any reproduction, imitation, or facsimile of a license plate with a similar design, shape, size, and color as the plates purchased by the Honolulu director of finance.

Allows the transfer of special number plates upon the transfer or sale of a vehicle.  Authorizes the removal of an organization from the special number plates program if the organization does not achieve the requisite number of one hundred fifty participants within 3 years.

RELATING TO COMMERCIAL DRIVER'S LICENSING.

Prohibits a person from operating a commercial motor vehicle if the driver tests positive for a controlled substance or alcohol.  Allows the examiner of drivers to suspend, revoke, or cancel any commercial driver's license or permit without a hearing under certain circumstances.

Reduces the amount of general excise tax revenues deposited into the state educational facilities improvement special fund by the amount of certificates of participation authorized for that fiscal year.

Allows deductions for health care costs (which includes long-term care insurance premium costs) for amounts in excess of 0.5% (rather than 7.5%) of adjusted gross income.

RELATING TO MENTAL HEALTH PRESCRIPTION DRUGS.

Add language that prohibits the Department of Human Services from restricting a physician's abililty to treat patients with mental illnesses though the use of a restrictive formulary, therapeutic substitution, or preferred drug classification.

RELATING TO INJURY PREVENTION.

Requires counties to adopt ordinances requiring the installation of window guards and locks located at the top of lanai doors in all dwelling units in which a child or chlidren 10 years of age and under reside.

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Prohibits tenants or guests from unlawfully possessing dangerous, harmful, or detrimental drugs in a dwelling unit or on surrounding premises.  Authorizes a summary eviction proceeding for violation of the prohibition, wherein the landlord may rely upon notices or reports issued by law enforcement.

RELATING TO HEALTH INSURANCE.

Requires insurers, mutual benefit societies, and health maintenance organizations to provide employers with employee group health claims experience under the employer health plan for the current policy period within 90 days of a request.  Authorizes reasonable fees.  Provides exceptions.

RELATING TO BROKERAGE RELATIONSHIPS.

Adds new chapter governing brokerage relationships to the Hawaii Revised Statutes.  Appropriates $      from the Real Estate Education Fund for consumer and licensee educational programs and a real estate brokerage specialist position within the Department of Commerce and Consumer Affairs.

RELATING TO NATURAL DISASTERS.

Authorizes Hawaii hurricane relief fund moneys to be used for other natural disasters and acts of terrorism.  Clarifies that disaster relief covers acts of terrorism.

RELATING TO FORCE-PLACED INSURANCE.

Allows lenders who force-place motor vehicle insurance on the vehicle that is the subject of the loan to obtain reimbursement from the borrower for insurance premiums that do not exceed the lesser of rates allowed by the Insurance Commissioner, or 110 percent of the rate the buyer can obtain for the same coverage; allows a borrower to obtain a policy to replace the force-placed insurance.
