RELATING TO RENEWABLE PORTFOLIO STANDARDS.

Amends the renewable portfolio standards law by requiring electric utility companies to increase their percentage of electrical energy sales represented by renewable energy to 10% by 2010 and to 20% by 2020. Makes goals mandatory, disallows PUC waivers, and imposes civil penalties.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST PROJECTS ON THE ISLANDS OF MAUI AND HAWAII.

Authorizes issuance of $55 million in special purpose revenue bonds for wind farms on the islands of Maui and Hawaii.

RELATING TO ENERGY.

Requires the auditor to contract with the National Conference of State Legislatures to conduct a statewide energy audit; establishes scope of the audit; appropriates $50,000 for fiscal year 2003-2004.

Enacts the Clean Power Act to regulate power plants and control emissions of nitrogen oxide, sulfur dioxide, mercury, and carbon dioxide; requires the Department of Health to formulate a comprehensive emission control plan and to adopt rules; requires Public Utilities Commission to adopt energy efficiency plan.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST INDUSTRIAL ENTERPRISES.

Authorizes issuance of up to $25,000,000 in special purpose revenue bonds to assist Barlow Projects Hawaii, LLC, a subsidiary of Barlow Projects, Inc., an individual enterprise.

RELATING TO ENERGY CONSERVATION INITIATIVES.

Provides for solar general obligation bonds to finance solar facilities and equipment for state facilities; geothermal royalties for hydrogen research and development; statewide energy audit; and two-year extension of the energy conservation tax credit.

RELATING TO THE PUBLIC UTILITIES COMMISSION.

Requires the public utilities commission to maintain a web site that includes all decisions and orders, and listings of open dockets, upcoming meetings, and pending deadlines. Requires applicants to provide the commission with PDF-formatted compact discs or other electronic format prescribed by the commission, for all filed documents. Provides that the time period within which commission action is due starts to run upon the posting of a substantially complete filing on the web site.

RELATING TO ENERGY.

Authorizes the issuance of revenue bonds to finance the acquisition, construction, rehabilitation, installation, and improvement of solar energy, energy conservation, and renewable energy facilities and equipment for various agencies, departments, and enterprises of the State.

RELATING TO IMPROVING END OF LIFE CARE.

Appropriates $225,074 for FY 2003-2004 and FY 2004-2005 to fund the creation of an end of life center. Creates end of life center within executive office on aging.

RELATING TO LIABILITY.

Limits the State's and counties' liability for injury or death to any person arising from the use of any beach or hiking trail that is owned or controlled by the State or counties, unless the injury or death resulted from gross negligence or wilful and wanton misconduct on the part of the State or counties.

RELATING TO THE RETIREMENT ALLOWANCE FOR PRINCIPALS AND VICE PRINCIPALS.

Provides for an increased retirement allowance under the "employees retirement system" for persons who serve as principals and vice principals in public schools; allows current members to receive an increased allowance without making additional contributions if the member serves for at least five years after the effective date of this Act as a principal or vice principal.

RELATING TO PRINCIPALS.

Replaces the current system of tenure for principals with a system where principals will be retained through performance contracts, with reappointment being contingent upon teacher and parent input and indicators of school and student achievement.

Excludes public school principals from collective bargaining.

RELATING TO SPECIAL PAY FOR TEACHERS.

Authorizes unilateral differential pay for special education teachers, teachers of subjects for which there are shortages of qualified teachers, and teachers in schools that have experienced difficulty in attracting and retaining teachers because of the geographic location of the school or the environmental difficulties at the school.

RELATING TO TEACHER STANDARDS.

Allows individuals with higher education teaching experience to teach in the public schools without requiring them to possess a license. Allows principals to use their discretion to hire these adjunct teachers to staff up to 10% of the school's total classroom teachers.

Allows a teacher to exclude from the classroom any student who engages in disruptive behavior.

RELATING TO THE DEPARTMENT OF EDUCATION.

Eliminates the cap on the number of charter schools that can be created. Allows the review panel to reject an implementation plan submitted by a proposed new century charter school.

Clarifies that charter school employees are exempt from collective bargaining. Specifies that charter school employees are employees of the charter school local board and are not state employees, but may opt to participate in state benefits.
