Prohibits persons under 18 years of age from possessing tobacco products.  Provides an exemption for possession or custody of tobacco by a minor in the course of delivery pursuant to the direction of a minor's employer lawfully engaged in business necessitating the delivery.

RELATING TO THE REGULATION OF TOBACCO PRODUCTS.

Requires tobacco manufacturers to report yearly to DOH on added constituents and nicotine in tobacco products.  Requires DOH to investigate public health risks and develop standards to reduce risks associated with exposure to these constituents.  Deletes tobacco products from definition of "consumer commodity."

RELATING TO SMOKING.

RELATING TO THE TOBACCO SETTLEMENT MONEYS.

Increases the portion of tobacco settlement moneys going into the Hawaii tobacco prevention and control trust fund from 12.5% to 25% and decreases the portion going to the emergency and budget reserve fund from 24.5% to 12%.

RELATING TO RENEWABLE ENERGY.

Authorizes an income tax credit for renewable energy technology systems that are installed and placed in service after 6/30/04.

RELATING TO ENERGY EFFICIENCY IN STATE FACILITIES.

Authorizes the director of finance to issue $100,000,000, in general obligation bonds for the purpose of improving energy management in state facilities in order to save taxpayer dollars and reduce emissions that contribute to air pollution and global climate change.

RELATING TO PUBLIC UTILITIES.

Allows the public utilities commission in ratemaking proceedings to consider factors that influence an adequate supply of energy, encourage energy conservation, or encourage renewable energy development; provided that the PUC makes findings on the utility's ability to recover its capital and operating costs.

RELATING TO PUBLIC UTILITIES.

Requires retail suppliers of electricity to annually disclose information on the fuel mix of the electricity services they sell to customers.

RELATING TO ENVIRONMENTAL HEALTH.

Prohibits (within 1 year after its effective date) a person from using, selling, offering for sale, distributing, blending, or manufacturing methyl tertiary butyl ether (MTBE) as a motor fuel additive in this State, except in "trace amounts" (i.e., not greater than 0.5 per cent by volume of the motor fuel).

RELATING TO RENEWABLE PORTFOLIO STANDARDS.

Increases renewable portfolio standard goals for electric utility companies to at least an additional 1% of the company's net electricity sales per year after 12/31/03, so that 20% of its net electricity sales are procured from eligible renewable energy resources by 12/31/16.

RELATING TO PRESCRIPTION DRUG COST CONTROL.

Establishes a prescription drug cost control education program to provide physicians with unbiased information on cost-effective use of prescription drugs; requires prescription drug manufacturers to disclose certain expenditures.

RELATING TO TELEPHONE SOLICITATIONS.

Prohibits phone solicitors from placing calls to residents who are registered on a no-call list.  Establishes a website and database containing the no-call list.

Prohibits as an unfair or deceptive act or practice, unsolicited telemarketing transmissions of text, graphic, or image messages by telephone solicitors to cellular telephones and pagers equipped with text messaging or similar capabilities.

RELATING TO PHARMACEUTICAL BENEFIT MANAGEMENT COMPANIES.

Establishes duties and obligations for pharmaceutical benefit management companies who administer or manage prescription drug benefit coverage to their clients.

RELATING TO PRESCRIPTION DRUG COST CONTAINMENT AND AFFORDABLE ACCESS.

Requires pharmaceutical manufacturing companies to disclose to the board of pharmacy the value, nature, and purpose of any gift, payment, or other economic benefit worth $25 or more provided with promotional or other marketing activities to physicians, hospitals, nursing homes, and pharmacists.

RELATING TO RECIPROCAL BENEFICIARIES.

Requires establishment of reciprocal beneficiary family benefits coverage for an employee reciprocal beneficiary, the other party to the relationship, dependent beneficiaries, unmarried children of the non-employee reciprocal beneficiary under age 19, and surviving beneficiaries.

Requires spousal or reciprocal beneficiary consent to any retirement benefit option selected by a member.  Designates option    as the retirement benefit option when a spouse or reciprocal beneficiary refuses to consent to a member's election of a benefit option, but entitles the spouse or reciprocal beneficiary to an annuity of   % of the allowance received by the member before death.
