Provides that a public employee who has been convicted of a felony that took place within the course and scope of the employee's duties must forfeit the employee's benefits starting from the date of the act constituting the felony of which the employee was convicted.

RELATING TO CRIME.

RELATING TO CRIME VICTIM COMPENSATION.

Exempt government records of the Crime Victim Compensation Commission from the Uniform Information Practices Act; allow funds from nonpayable restitution to be used for crime victim compensation, rather than escheating to the State; allow commission to transfer compensation awards to minors under the Uniform Transfers to Minors Act; give commission authority to expand coverage for mental health services; rename the "pain and suffering" award to more clearly reflect the purpose of the award; and require the judiciary to transmit an annual report to the legislature per progress in meeting the requirements of Act 206, Session Laws 1998.

RELATING TO CHAPTER 846E, HAWAII REVISED STATUTES.

Clarifies that hearings related to the release of sex offender information are civil in nature and that the State is represented by the prosecuting attorney in these hearings. Repeals the process for reevaluating court orders granting public access to information regarding sex offenders. Specifies that the sex offender must give appropriate notifications whenever any of the sex offender's registration information changes.

Amends campaign spending laws to provide alternative public funding for state house of representatives candidates who voluntarily abide by certain contribution and expenditure limits. Appropriates $150,000 to the campaign spending commission for additional clean elections support staff.

Article VII, Section 3 of the Hawaii Constitution provides that "there shall be a tax review commission which shall be appointed by law on or before July 1, 1980, and every 5 years thereafter." The Tax Review Commission is charged with the duty to "submit to the Legislature an evaluation of the State's tax structure, recommend revenue and tax policy and then dissolve." The statute implementing the Commission further provides that the Commission "shall conduct a systematic review of the State's tax structure, using such standards as equity and efficiency."

The 2001 Tax Review Commission completed its work and submitted its report to the Legislature on December 6, 2002. The members of the Commission have been invited and will provide an overview of their report.

PROPOSING AMENDMENTS TO ARTICLE VII, SECTION 8, AND ARTICLE X, SECTION 5, OF THE HAWAII CONSTITUTION, TO PROVIDE THE UNIVERSITY OF HAWAII WITH COMPLETE AUTONOMY FROM THE EXECUTIVE BRANCH. Provides complete autonomy to UH and removes UH from executive branch; specifies that UH shall receive no general funding. Requires Board of Regents to submit a separate budget to Legislature.
