Requires the department of public safety rather than the department of education to carry out the initial and ongoing training of school security attendants after 6/30/02, subject to the availability of funding. Appropriates funds for the training of security attendants for school campuses.

Replaces existing county liquor commissions with a statewide commission and gives commission jurisdiction over licensure of retail sales of tobacco.

Creates statewide licensure mechanism for retail tobacco sales that provides for licensing retail tobacco vendors, inspections and enforcement, adjudication of fines and penalties, training and education for retail merchants and public awareness of the State's statute governing the sale of tobacco to minors.

RELATING TO TOBACCO SALES TO MINORS.

Substitutes "entity" for "person" relating to a negligent violation of selling a tobacco product to a minor. Defines "entity." Clarifies fine of $500 for first offense is a mandatory minimum. Increases fine on minors from $10 to $50 for first offense and from $50 to $100 for subsequent offenses.

RELATING TO HEALTH.

Makes various amendments to further clarify the adult residential care homes law. Provides DOH with the discretion to allow more nursing facility residents to be allowed to live at adult residential care homes.

Repeals joint formulary advisory committee. Allows therapeutically certified optometrists to prescribe and use all pharmaceuticals approved by the optometry board, with additional restrictions and requirements for consultation. Prohibits the use of injectable agents.

Amends the law relating to geothermal royalties to require 80% of geothermal royalties to be paid to the county of Hawaii and 20% to be paid to the office of Hawaiian affairs.

Requires DBEDT to establish and publish each quarter a maximum wholesale gasoline price in the State based on the average price of crude oil prices in four markets. Prohibits major oil companies from charging more than this maximum price to retailers. Imposes civil penalties.
