SENATE RESOLUTION

 

REQUESTING THE DEPARTMENT OF HUMAN SERVICES TO CONDUCT A SURVEY OF AUTOMOBILE INSURANCE FOR EMPLOYEES OF NONPROFIT ORGANIZATIONS.

 

WHEREAS, the Department of Human Services often utilizes the services of private nonprofit organizations to provide services through purchase of service contracts; and

WHEREAS, nonprofit organizations many times by necessity utilize the motor vehicles of paid employees in order to carry out functions of the organizations such as delivering goods and transporting clients and customers; and

WHEREAS, concern has been expressed over the costs of providing adequate motor vehicle liability insurance to cover employees' personal vehicles while being used for work purposes especially since many nonprofit organizations have limited resources and operating budgets; and

WHEREAS, the administrative costs of nonprofit organizations could increase significantly if they choose to provide motor vehicle insurance for all employees that use personal vehicles for work purposes; and

WHEREAS, in the absence of employer-provided vehicle liability coverage, employees may be required to purchase additional coverage from their personal insurance companies, which may cause many employees to choose not to use their vehicles for work purposes; and

WHEREAS, if employees do not use their personal vehicles to transport clients and perform other work-related duties, the quantity and quality of services could be seriously affected; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-First Legislature of the State of Hawaii, Regular Session of 2002, that the Department of Human Services is requested to conduct a survey of all the nonprofit organizations it has contracted with in calendar year 2002, to determine if costs associated with ensuring adequate motor vehicle liability coverage for their employees who use their own motor vehicles in performing duties for the organization, has impacted the ability of the organizations to bid for, and receive, contracts with the State or perform the services of state contracts; and

BE IT FURTHER RESOLVED that the Department of Human Services shall submit its written findings and recommendations, if any, to the Legislature at least twenty days prior to the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Director of Human Services.
